DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-OOXX 89 <br /> FORWARD, INC. <br /> FORWARD LANDFILL <br /> SAN JOAQUIN COUNTY <br /> STANDARD PROVISIONS & REPORTING REQUIREMENTS <br /> (C) Add any five-year analyte that is confirmed per this <br /> method to the monitoring parameter list such that it is <br /> monitored during each regular monitoring event. <br /> 48. Physical Evidence of a Release. If the Discharger determines that there <br /> is a significant physical evidence of a release, the Discharger shall <br /> immediately verbally notify Central Valley Water Board staff and provide <br /> written notification by certified mail within 7 days of such determination, <br /> and within 90 days shall submit an amended report of waste discharge to <br /> establish an Evaluation Monitoring Program [Title 27, § 20385(a)(3) and <br /> § 20420(1)(1) & (2)]. <br /> J. Response to Release <br /> 1. Measurably Significant Evidence of a Release Has Been Confirmed. If the <br /> Discharger has confirmed that there is measurably significant evidence of <br /> a release from a waste management unit pursuant to Standard Monitoring <br /> Specification 1.46 or 1.47, then the Discharger shall: <br /> a. Immediately sample all monitoring points in the affected medium at <br /> that waste management unit and determine the concentration of all <br /> monitoring parameters and constituents of concern for comparison <br /> with established concentration limits. Because this constituent of <br /> concern scan does not involve statistical testing, the Discharger will <br /> need to collect and analyze only a single water sample from each <br /> monitoring point in the affected medium [Title 27, § 20420(k)(1)]. <br /> b. Within 14 days of confirming measurably significant evidence of a <br /> release, the Discharger shall (for releases from MSW landfill units) <br /> notify all persons who own the land or reside on the land that <br /> directly overlies any portion of the plume of contamination if <br /> contaminants have migrated off-site if indicated by sampling of <br /> detection monitoring wells [40 C.F.R. § 258.55(g)(1)(iii)]. <br /> C. Within 90 days of confirming measurably significant evidence of a <br /> release, the Discharger shall submit an amended report of waste <br /> discharge to establish an Evaluation Monitoring Program meeting <br /> the requirements of Title 27, sections 20420(k)(5)(A-D), including <br /> but not limited to the results of sampling pursuant to paragraph <br /> J.1.a, above. The Evaluation Monitoring Program shall be designed <br /> for the collection and analysis of all data necessary to assess the <br /> nature and extent of the release and to determine the spatial <br /> distribution and concentration of each constituent throughout the <br />
