DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-OOXX 90 <br /> FORWARD, INC. <br /> FORWARD LANDFILL <br /> SAN JOAQUIN COUNTY <br /> STANDARD PROVISIONS & REPORTING REQUIREMENTS <br /> zone affected by the release [Title 27, § 20420(k)(5) and <br /> § 20425(b)]. For releases from MSW landfill units, the Evaluation <br /> Monitoring Program shall also include any additional proposals <br /> necessary to comply with 40 C.F.R. § 258.55, particularly the <br /> additional monitoring well required by 40 C.F.R. § 258.55(g)(1)(ii). <br /> d. Within 180 days of confirming measurably significant evidence of a <br /> release, the Discharger shall submit to the Central Valley Water <br /> Board an initial engineering feasibility study for a Corrective Action <br /> Program necessary to meet the requirements of Title 27, section <br /> 20430. At a minimum, the initial engineering feasibility study shall <br /> contain a detailed description of the corrective action measures that <br /> could be taken to achieve background concentrations for all <br /> constituents of concern [Title 27, § 20420(k)(6)]. <br /> e. If the Discharger confirms that there is measurably significant <br /> evidence of a release from the waste management unit at any <br /> monitoring point, the Discharger may attempt to demonstrate that a <br /> source other than the waste management unit caused the evidence <br /> of a release or that the evidence is an artifact caused by an error in <br /> sampling, analysis, or statistical evaluation or by natural variation in <br /> groundwater, surface water, or the unsaturated zone. The <br /> Discharger may make a demonstration pursuant to Title 27, section <br /> 20420(k)(7) in addition to or in lieu of submitting both an amended <br /> report of waste discharge or an engineering feasibility study; <br /> however, the Discharger is not relieved of the requirements and <br /> due dates of Title 27, sections 20420(k)(6) & (7) unless Central <br /> Valley Water Board staff agree that the demonstration successfully <br /> shows that a source other than the waste management unit caused <br /> the evidence of a release or that the evidence resulted from error in <br /> sampling, analysis, or statistical evaluation or from natural variation <br /> in groundwater, surface water, or the unsaturated zone. In order to <br /> make this demonstration, the Discharger shall notify the Central <br /> Valley Water Board by certified mail of the intent to make the <br /> demonstration within seven days of determining measurably <br /> significant evidence of a release, and shall submit a report <br /> within 90 days of determining measurably significant evidence of a <br /> release [Title 27, § 20420(k)(7)]. <br /> If. Within 90 days of the date that the Evaluation Monitoring Program <br /> from paragraph J.1.c is approved (the date is it established), the <br /> Discharger shall complete and submit the following: <br />
