The report was provided to the business at the time of the inspection. <br /> REGULATION GUIDANCE: The operator of the site or facility which receives an inspection report shall submit a <br /> written response to the department or the local officer or agency authorized to enforce this chapter pursuant to <br /> subdivision (a)of Section 25180 within 60 days of receipt of the inspection report, or within a shorter time as the <br /> department or the local officer or agency may reasonably require,which shall include a statement documenting <br /> corrective actions taken by the operator or proposing corrective actions which will be taken by the operator,for <br /> purposes of compliance with this chapter, or disputing the existence of the violation. The local agency,the San <br /> Joaquin County Environmental Health Department, requires response within 30 days. <br /> CORRECTIVE ACTION: Provide a corrective action statement and supporting documentation to the San Joaquin <br /> County Environmental Health Department. <br /> This is a repeat violation, Class ll. <br /> 301 CCR 66262.34(d)(2) Facility not maintained to minimize the release of a hazardous waste. <br /> OBSERVATION: The hose at dispenser 9 was observed to be actively leaking diesel onto the concrete at the time <br /> of the inspection. <br /> REGULATION GUIDANCE:A hazardous waste generator must maintain and operate its facility to minimize the <br /> possibility of a fire, explosion, or any unplanned sudden or non-sudden release of hazardous waste or hazardous <br /> waste constituents to air, soil, or surface water which could threaten human health or the environment. <br /> CORRECTIVE ACTION: Immediately fix the leak and clean-up the release. Manage the waste according to Title 22 <br /> California Code of Regulations for hazardous waste. Submit a statement and supporting documentation to the San <br /> Joaquin County Environmental Health Department describing the storage and final disposition of the cleaned up <br /> waste. <br /> This is a repeat violation, Class Il. <br /> 601 CCR 66262.34(d)Stored hazardous waste onsite greater than 180 days(90 days acute/extremely). <br /> OBSERVATION: The following hazardous waste containers were found on-site without an accumulation start date: <br /> one 55 gallon drum of fuel contaminated water. <br /> REGULATION GUIDANCE: Title 22 California Code of Regulations section 66262.34. <br /> CORRECTIVE ACTION: Immediately dispose of the hazardous waste stored on site greater than 180 days in <br /> compliance with Title 22 California Code of Regulations.
