Environmental Health Department Underground Storage Tank Program Inspection Report Date: October 17, 2023 Facility Address: 2758 W Kettleman Ln, Lodi Facility Name: Sunwest Chevron SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # -Section 5 was missing the UST owner/operator’s response. REGULATION GUIDANCE: During the visual inspection, the designated operator shall check that all required testing and maintenance for the UST system have been completed and shall check all required items on the report. CORRECTIVE ACTION: Ensure that designated operators performing visual inspections at this facility are including all of the required information on the reports. This is a repeat violation, Class II. 209 CCR 2715(c)(3), 2715(c)(4) Failure to maintain a copy of the "Facility Employee Training Certificate" on-site. OBSERVATION: The Facility Employee Training Certificate dated 9/27/2023 listed incorrect initial training dates and is missing assumed responsibly dates. REGULATION GUIDANCE: All site employees must be trained prior to taking responsibility as a facility employee if after October 1, 2018, or within 30 days of hire if prior to October 1, 2018. The Facility Employee Training Certificate shall contain accurate information for all employees trained. CORRECTIVE ACTION: Update the Facility Employee Training Certificate to contain the accurate information and submit a copy of the updated form to the EHD. This is a repeat violation, Class II. 214 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION: The content of the diesel tank was changed to Biodiesel B20 approximately 10 months ago and a permit was not obtained from the EHD. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed, trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD . A “Failure to Obtain a Permit” penalty applies. This is a repeat violation, Class II.
