DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-00XX 51 <br />FORWARD, INC. <br />FORWARD LANDFILL <br />SAN JOAQUIN COUNTY <br />reported to the Central Valley Water Board as part of the Construction <br />Quality Assurance (CQA) Report. <br />8.The Discharger shall include estimated final closure dates of the WMUs in <br />the Annual Monitoring Report E.2 as specified in MRP R5-2023-00XX. <br />F. Financial Assurances—Except as otherwise directed below, the Discharger <br />shall comply with all Standard Financial Assurance Provisions (SPRRs, <br />section H), as well as the following. <br />1. The Discharger shall maintain with CalRecycle assurances of financial <br />responsibility for the amounts specified for each category in Finding 131, <br />adjusted annually for inflation. <br />2. A report regarding financial assurances, or a copy of the financial <br />assurances report submitted to CalRecycle, shall be submitted to the <br />Central Valley Water Board annually, no later than 1 June. <br />3. If CalRecycle determines that the submitted financial assurances for the <br />Facility are inadequate,the Discharger shall, within 90 days of such <br />determination: <br />a. Obtain a new financial assurance mechanism for the amount <br />specified by CalRecycle; and <br />b. Submit a report documenting such financial assurances to <br />CalRecycle and the Central Valley Water Board. <br />4. The operative Preliminary CPMP shall include all components required <br />per Title 27 section 21769, subd. (c), and include a lump sum cost <br />estimate for: <br />a. Completion of all actions required for closure of each WMU; <br />b. Preparation of detailed design specifications; <br />c. Development of a Final CPMP; and <br />d. Undertaking at least 30 years of post-closure maintenance. <br />5. Whenever changed conditions increase the estimated costs of closure and <br />post-closure maintenance, the Discharger shall promptly submit an <br />updated CPMP to the Central Valley Water Board, CalRecycle and the <br />LEA.
