DRAFT [TENTATIVE] WASTE DISCHARGE REQUIREMENTS ORDER R5-2023-00XX 99 <br />FORWARD, INC. <br />FORWARD LANDFILL <br />SAN JOAQUIN COUNTY <br />STANDARD PROVISIONS & REPORTING REQUIREMENTS <br />waste management units and during subsequent use of the property for <br />other purposes. <br />5.The fact that it would have been necessary to halt or reduce the permitted <br />activity in order to maintain compliance with this Order shall not be <br />regarded as a defense for the Discharger’s violations of this Order. <br />6.The Discharger shall notify the Central Valley Water Board of a material <br />change in; the types, quantity, or concentrations of wastes discharged; <br />site operations and features; or proposed closure procedures, including <br />changes in cost estimates. This notification shall be given a reasonable <br />time before the changes are made or become effective. No changes shall <br />be made without Central Valley Water Board approval following <br />authorization for closure pursuant to the site Notification of Closure <br />[Title 27, § 21710(a)(4)]. <br />7.The Discharger shall maintain legible records of the volume and type of <br />each waste discharged at each waste management unit or portion of a <br />unit, and the manner and location of discharge. Such records shall be <br />maintained by the Discharger until the beginning of the post-closure <br />maintenance period. These records shall be on forms approved by the <br />State Water Board or Central Valley Water Board and shall be maintained <br />at the waste management facility until the beginning of the post-closure <br />maintenance period. These records shall be available for review by <br />representatives of the State Water Board or Central Valley Water Board at <br />any time during normal business hours. At the beginning of the post- <br />closure maintenance period, copies of these records shall be sent to the <br />Central Valley Water Board [Title 27, § 21720(f)]. <br />8.In the event of any change in landowner or the operator of the waste <br />management facility, the Discharger shall notify the succeeding owner or <br />operator in writing of the existence of this Order. A copy of that notification <br />shall be sent to the Central Valley Water Board. <br />9.In the event of any change of ownership or responsibility for construction, <br />operation, closure, or post-closure maintenance of the waste discharge <br />facilities described in this Order, the Discharger shall notify the Central <br />Valley Water Board prior to the effective date of the change and shall <br />include a statement by the new Discharger that construction, operation, <br />closure, or post-closure maintenance will be in compliance with this Order <br />and any revisions thereof [Title 27, § 21710(c)(1)]. <br />10.To assume ownership or operation under this Order, the succeeding <br />owner or operator must apply in writing to the Central Valley Water Board
