Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />December 06, 2023 <br /> Facility Address: <br /> 4239 POCK LN, STOCKTON <br /> Facility Name: <br /> WORLD CLASS DISTRIBUTION <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 7 HSC 25505(a)(3) Failed to electronically submit an adequate ER procedures for a release or threatened release. <br />OBSERVATION: The emergency response(ER) plan is inaccurate. Mason Miller is listed as the secondary <br />emergency coordinator. Per on-site personnel, Mason Miller's employment ended with the facility a few months <br />ago. <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a <br />release or threatened release of hazardous materials, including, but not limited to, the following: <br /> - immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br /> - procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br /> - evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br /> 10 HSC 25508.1(a)-(f) Failed to electronically update the HMBP within 30 days of substantial change in operations. <br />OBSERVATION: During the inspection, on-site personnel stated that Mason Miller's employment with the facility <br />ended a few months ago. Mason Miller is still listed as the secondary emergency contact on the owner/operator <br />identification form and as a secondary emergency coordinator on the emergency response plan. The business has <br />not updated and submitted the changes in the California Environmental Reporting System within 30 days. <br />REGULATION GUIDANCE: Within 30 days of one the following events, business shall electronically update the <br />information submitted to the California Environmental Reporting System (CERS): <br /> a) A 100 percent or more increase in the quantity of a previously disclosed material. <br /> b) Any handling of a previously undisclosed hazardous materials <br /> c) A change of business or facility address <br /> d) Change business ownership <br /> e) Change of business name <br /> f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the <br />business plan. <br /> (2) For the purpose of this subdivision, “substantial change” means any change in a facility that would inhibit <br />immediate response during an emergency by either site personnel or emergency response personnel, or that could <br />inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, <br />or impede implementation of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />This is a Class II violation. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 4 violations during the <br />inspection.
