OBSERVATION: The E85/Diesel annular sensor failed to activate an audible and visual alarm when tested and, therefore,the tank is not monitored. REGULATION GUIDANCE: The UST system shall be designed and constructed with a monitoring system capable of detecting leaks from primary containment into secondary containment. CORRECTIVE ACTION: Immediately contact a properly licensed,trained, and certified contractor to replace the failed component with a functional component, and obtain a permit within one business day from the EHD, if needed. This is a Class II violation. 317 CCR 2636(f)(2) Failure of the line leak detector to detect a 3.0 gph leak at 10 psi and restrict or shut off flow. OBSERVATION: The Diesel line leak detector failed to detect a leak when tested. REGULATION GUIDANCE:All line leak detectors shall be capable of detecting a 3-gallon per hour leak at 10 psi. CORRECTIVE ACTION: Immediately have a properly licensed,trained, and certified contractor repair or replace the failed leak detector(LG 113-x listed, if applicable)and obtain a permit within one business day from the EHD, if needed. If the failed leak detector can't be replaced immediately,there is a possibility that the Diesel UST system may be red tagged to prevent fuel inputs. This is a repeat violation, Class II. 318 CCR 2635, 2637.1,2665, 2712 Failed to meet spill container requirements. OBSERVATION: The 91 direct-bury spill container failed when tested. REGULATION GUIDANCE:All spill containers shall have a minimum capacity of five gallons and be capable of containing a spill or overfill until it is detected or cleaned up. CORRECTIVE ACTION: Immediately discontinue deposition of petroleum into this tank until the component is repaired or replaced by a properly licensed, trained, and certified contractor under permit and inspection of the EHD. If the spill container can't be replaced immediately,there is a possibility that the 91 UST system may be red tagged to prevent fuel inputs. This is a Class II violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 02/11/2024 .
