(39 -CR -0022) - 17200 Murphy Parkway Parcel (Former SAN JOAQUIN
COGENERATION," APN 198-120-05)
Good morning Natalia and Muniappa,
Thank you for meeting with Sabra and me on April 10th regarding the above -referenced portion of the
Pilkington Disposal Site. As we discussed, Natalia will be checking the file to ascertain whether CalRecycle was
involved with the LEA's review and/or approval (on 7/19/2018) of the Clean Closure Plan for a different
portion of this disposal site, a related parcel located at 17100 Murphy Parkway (aka Parcel B), APN 198-120-
09. If CalRecycle was so involved, this would open the door for you to request, if you so elect, for CalRecycle
to provide engineering technical guidance with respect to the subject parcel. If CalRecycle was not so
involved, I suggested at our meeting that you immediately contact your County counsel assigned to represent
the LEA as to the best manner for you to proceed with the subject parcel, in light of the LEA approval provided
for the related parcel. I also offered to meet with your counsel (as well as each of you with your counsel if
you'd all like), to address any legal issues or questions in that regard. I further advised that in this latter
scenario, I would be your point of contact with respect to the subject parcel going forward. Finally, as I
emphasized during our call, our CIA Unit encourages you to continue to utilize our staff for engineering
technical guidance on any other sites presenting new work/investigation/remediation/PCLU plans/reports
going forward, so that we may timely provide our suggested input prior to the LEA making any determination
as to whether such plans/reports are approvable.
Thank you,
Steven Levine, Sr. Staff Counsel
CalRecycle - California Department of Resources, Recycling and Recovery
Cal Recyc#eo
CONFIDENTIALITY NOTICE: This communication with its contents may contain confidential and/or legally
privilegedinformation.
