CONDITIONS OF APPROVAL <br /> PA-2300299 <br /> RONALD & CAROL RUGANI TRUST / DILLON & MURPHY <br /> Minor Subdivision Application No . PA-2300299 was approved by the Community Development <br /> Department on April 10 , 2024 . The effective date of approval is April 20 , 2024 . This tentative map <br /> approval will expire on April 20 , 2027 , which is three (3 ) years from the effective date of approval , unless <br /> ( 1 ) all Conditions of Approval have been complied with and ( 2) a Parcel Map has been filed with and <br /> accepted by the County Surveyor. <br /> Unless otherwise specified , all Conditions of Approval and ordinance requirements shall be fulfilled <br /> prior to approval of the Parcel Map . Those Conditions followed by a Section Number have been <br /> identified as ordinance requirements pertinent to this application . Ordinance requirements cannot be <br /> modified , and other ordinance requirements may apply . <br /> 1 . COMMUNITY DEVELOPMENT DEPARTMENT ( Contact : Community Development Department , [209 ] <br /> 468 - 3121 ) <br /> a . TENTATIVE MAP : The Parcel Map shall substantially conform to the approved tentative map dated <br /> December 28 , 2023 . <br /> b . RIGHT TO FARM : Pursuant to San Joaquin County Code Section 6 - 9004 ( b ) , the following note shall <br /> be placed on the Parcel Map and recorded as a separate instrument : <br /> All persons purchasing parcels within the boundaries of this approved map should be prepared <br /> to accept the inconveniences or discomforts associated with agricultural operations or activities , <br /> such as noise , odors , insects , dust , or fumes . San Joaquin County has determined that such <br /> inconveniencies or discomforts shall not be considered to be a nuisance . <br /> c . LOT SIZE AND WIDTH : The following lot size and width regulations shall apply to this map : <br /> 1 . Parcel 1 shall be 33 . 4 acres ( Variance application No . PA- 2300015 ) . <br /> 2 . Parcel 2 shall be a minimum of 4 . 10 acres ( Variance application No . PA- 2300015 ) . <br /> 3 . Parcel 1 and parcel 2 shall have a minimum lot width of 330 feet , measured at the front yard <br /> setback line . ( Development Title Table 9 - 203 . 030 ) <br /> d . JOINT MANAGEMENT AGREEMENT : An approved Joint Management Agreement for all parcels <br /> below the 10 - acre minimum parcel size must remain in effect for as long as the parcels are under a <br /> Williamson Act contract . <br /> e . MITIGATION MONITORING AND REPORTING PROGRAM : The project shall comply with all <br /> required mitigations included in the MMRP dated March 2024 ( attached ) . <br /> f . CULTURAL RESOURCES : If , in the course of development , concentrations of prehistoric or historic- <br /> period materials are encountered , all work in the vicinity of the find shall halt until an archaeologist can <br /> evaluate the materials and make recommendations for further action . If human remains are <br /> encountered , all work shall halt in the vicinity and the County Coroner shall be notified immediately . At <br /> the same time , a qualified archaeologist shall be contacted to evaluate the finds . If Human burials are <br /> found to be of Native American origin , steps shall be taken pursuant to Section 15064 . 5 ( e ) of <br /> Guidelines for California Environmental Quality Act . <br /> g . TREE PRESERVATION : Future development on the parcel ( s ) shall be consistent with the <br /> requirements of the County ' s Tree Preservation Ordinance ( Development Title Section 9 - 400 . 080 ) . <br /> PA- 2300299 — Conditions of Approval 1 <br />
