There are wastes that are listed as hazardous <br /> wastes. There are wastes that exhibit one or more of the hazardous waste characteristics:toxic, corrosive, reactive <br /> or ignitable. <br /> Title 22 CCR section 66261.2—Definition of Waste <br /> Title 22 CCR section 66261.3—Definition of Hazardous Waste <br /> A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 <br /> California Code of Regulations(CCR)section 66262.11 for at least three years from the date that the waste was last <br /> sent to an on-site or off-site treatment, storage,or disposal facility. The records may include Safety Data Sheets <br /> (SIDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Make a hazardous waste determination for the waste , and manage it according to Title <br /> 22 CCR. Use Safety Data Sheets (SIDS),waste sampling and test results or other knowledge to support your <br /> hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including <br /> sections 66261.20-24. <br /> This is a Class II violation. <br /> 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. <br /> OBSERVATION: The facility could not provide all of the consolidated manifest receipts for hazardous waste <br /> transported from the site in the past three years. The missing receipts include: waste that was picked up on <br /> 1/25/22 (012353719JJK), 6/7/22 (008343650SKS), 9/1/22 (008305630SKS), and 2/6/23(024226319JJK). <br /> REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. <br /> This period of retention is extended automatically during the course of any unresolved enforcement action regarding <br /> the regulated activity or as requested by the department or a certified unified program agency. <br /> CORRECTIVE ACTION: Locate a copy of the receipts listed above.
