OBSERVATION: A complete modified contingency plan with an assigned emergency coordinator was not posted at the facility.The emergency coordinator, Katherine Frazier,was listed as the primary emergency coordinator but has not been with the company for 2 years. REGULATION GUIDANCE: The emergency coordinator or his designee must respond to any emergencies that arise. The business operator must post the following information next to telephones or in areas directly involved in the generation and accumulation of hazardous waste: the name and emergency telephone number of the emergency coordinator, the location of fire extinguishers and spill control material, and the telephone number of the fire department unless the facility has a direct alarm. CORRECTIVE ACTION: Immediately update the contingency plan with correct information. Provide a statement to the San Joaquin County Environmental Health Department that the correction is complete. This is a Class II violation. 110 CCR 66262.40(a) Failed to keep signed copy of manifests from the designated facility for three years. OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three years during the inspection. REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste. This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. CORRECTIVE ACTION: Provide a copy of disposal records for the past three years 12/26/2020- 12/26/2023 for all hazardous waste including used oil, used oil filter, used absorbent. Provide these records and a corrective action statement to the EHD within 30 days. This is a Class II violation. 113 HSC 25160.2(b)(3) Failed to keep copies of consolidated manifesting receipts for three years. OBSERVATION: The business operator could not provide hazardous waste disposal records for the past three years during the inspection. REGULATION GUIDANCE: The generator shall retain each consolidated manifest receipt for at least three years. This period of retention is extended automatically during the course of any unresolved enforcement action regarding the regulated activity or as requested by the department or a certified unified program agency. CORRECTIVE ACTION: Provide a copy of disposal records for the past three years 12/26/2020-12/26/2023 for all hazardous waste including used oil, used oil filters, used absorbent.
