Environmental Health Department <br />Hazardous Materials Program Inspection Report <br />Date: <br />February 06, 2024 <br /> Facility Address: <br /> 8830 W LINNE RD, TRACY <br /> Facility Name: <br /> DYNATECT RO-LAB, INC. <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 8 HSC 25505(a)(4) Failed to establish and electronically submit a reasonable or an adequate training program. <br />OBSERVATION: A training program was not complete. Immediate notification contacts to the appropriate local <br />emergency response personnel and to the unified program agency was not identified in the training program. This <br />violation has been corrected on site. <br />REGULATION GUIDANCE: Training programs for all employees and annual training, including refresher courses, <br />shall include familiarity with the facility's Emergency response plans and procedures in the event of a release or <br />threatened release of a hazardous material. Training shall cover, but not limited to, all of the following: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br />program agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br /> These training programs may take into consideration the position of each employee. <br />CORRECTIVE ACTION: Immediately prepare or update the facility's training program, log into the California <br />Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, upload the correct or updated information, <br />and submit to the EHD for approval. <br />This is a Class II violation. <br /> 9 HSC 25508.2 Failed to annually review and certify that the HMBP is complete and accurate by the due date. <br />OBSERVATION: The business plan information has not been reviewed and resubmitted in the California <br />Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was submitted <br />late on 8/2/2022 for the year of 2022. The business plan was submitted late on 1/30/2023 for the year of 2023. The <br />business made a submittal on time for the year of 2024. This violation as been corrected. <br />REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar <br />year and may be submitted beginning November 1 of the previous year. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />This is a repeat violation, Class II. <br />Overall Inspection Comments: <br />Conducted a Hazardous Materials Business Plan (HMBP) inspection. There were 4 violations found during the <br />inspection. All violations were correct on site. The following areas were inspected; 4 buildings , hazardous waste <br />areas, and shop area. <br />To minimize person to person contact EHD is choosing to write the name of person receiving the report instead <br />of having them sign. Starting September 1, 2018, all in-office CERS help will be provided at EHD hourly rate <br />($162).
