Environmental Health Department <br />AMENDED <br />3/25/2024 <br />Hazardous Materials Program Inspection Report <br />Date: <br />February 07, 2024 <br /> Facility Address: <br /> 12253 N CLEMENTS RD, LINDEN <br /> Facility Name: <br /> UNLIMITED COMPANY INC DBA: SMIT FARMS <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br /> 5 HSC 25505(a)(1) Failed to electronically submit hazardous materials inventory for all reportable materials on site. <br />OBSERVATION: The facility brings in electrical equipment that contains lead acid batteries and other hazardous <br />chemicals. Employees will then dismantle the electrical equipment and sell the scrap metal for profit. Per Manager <br />JD Salisbury and his son Beau Salisbury, this activity is not a part of the farm. The farm workers do this to make <br />additional money during the slow season. <br />The following chemicals were observed on site during the inspection and were not in the hazardous material plan <br />-Approximately 15 pallets of various lead acid batteries. Several pallets contained batteries labeled as “PowerSafe <br />SBS” and several pallets contained batteries labeled as “Acme T Range Front Access Battery.” <br />-12 hydrogen tanks <br />-Multiple cylinders of propane <br />-Approximately 55 gallons of used oil (in a drum and used oil bucket). <br />REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part <br />of the business plan. <br />CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct information, and submit to the EHD for approval. Please note that all <br />hazardous chemicals stored on site any one time of the year above 55 gallons, 500 pounds or 200 cubic feet need <br />to be uploaded into CERS. Ensure that all chemicals brought onto the site (even if not apart of the farm business) <br />are reported. <br />This is a Class II violation. <br /> 6 HSC 25505(a)(2) Failed to electronically submit a site map with all required content. <br />OBSERVATION: A site map was not completed and submitted as part of the business plan. The facility selected <br />"stored at facility" in the California Environmental Reporting System (CERS) which is not a valid option. <br />REGULATION GUIDANCE: site map that contains north orientation, adjacent streets, access and exit points, <br />evacuation staging areas, hazardous material handling and storage areas, emergency response equipment, and, if <br />present, loading areas, internal roads, storm and sewer drains, and emergency shutoffs, as well as additional map <br />requirements the governing body of the unified program agency finds necessary. <br />CORRECTIVE ACTION: Immediately log into CERS at http://cers.calepa.ca.gov/, upload the correct or updated <br />information, and submit to the EHD for approval. <br />This is a repeat violation, Class II. <br />FA0026394 PR0546541 SC001 02/07/2024 <br />EHD 19-01 Rev. 12/06/2021 Hazardous Materials Program OIRPage 3 of 6 <br />1868 E.
