Environmental Health Department CP22 - AST Non-Qualified Inspection Report Date: May 21, 2024 Facility Address: 2800 TURNPIKE RD, STOCKTON Facility Name: VALLEY FARMS TRANSPORT SUMMARY OF VIOLATIONS (CLASS I, CLASS II, or MINOR - Notice to Comply) RemarksItem # -The Emergency Contact List has Stuart Davidson listed as the Risk Manager. Stuart Manager Erik Sandoval stated that Stuart has not been with the company since before Erik became an employee there in January 2023. -The Emergency Contact List has Matthew Nickum listed as the facility Manger. The current facility manager is Erik Sandoval. REGULATION GUIDANCE: The SPCC plan shall include: (vi) Contact list and phone numbers for the facility response coordinator, National Response Center, cleanup contractors with whom you have an agreement for response, and all appropriate Federal, State, and local agencies who must be contacted in case of a discharge as described in § 112.1(b). CORRECTIVE ACTION: Immediately amend the SPCC Plan to update the contact list and phone numbers for reporting a discharge. Submit proof of correction to the EHD. This is (Minor) Violation. Code of Fed Regulations 112.7(c) 4030037 - Appropriate (general) containment/diversionary structures/equipment have been provided. OBSERVATION: The facility failed to provide materials discussed in the SPCC Plan (soil/absorbent materials) to erect a temporary dam in the drainage ditch in the event that an uncontained release from AST -1 is headed towards the ditch. The materials discussed were not observed on site at the time of inspection. REGULATION GUIDANCE: (c) Provide appropriate containment and/or diversionary structures or equipment to prevent a discharge as described in § 112.1(b), except as provided in paragraph (k) of this section for qualified oil-filled operational equipment, and except as provided in § 112.9(d)(3) for flowlines and intra-facility gathering lines at an oil production facility. The entire containment system, including walls and floor, must be capable of containing oil and must be constructed so that any discharge from a primary containment system, such as a tank, will not escape the containment system before cleanup occurs. In determining the method, design, and capacity for secondary containment, you need only to address the typical failure mode, and the most likely quantity of oil that would be discharged. Secondary containment may be either active or passive in design. At a minimum, you must use one of the following prevention systems or its equivalent: (1) For onshore facilities: (i) Dikes, berms, or retaining walls sufficiently impervious to contain oil ; (ii) Curbing or drip pans; (iii) Sumps and collection systems; (iv) Culverting, gutters, or other drainage systems; (v) Weirs, booms, or other barriers; (vi) Spill diversion ponds; (vii) Retention ponds; or (viii) Sorbent materials. CORRECTIVE ACTION: Immediately provide materials to erect diversionary structures capable of containing oil and constructed so that any discharge will not escape the containment system before cleanup occurs for AST -1. Submit proof of correction to the EHD. OBSERVATION: Facility failed to provide training to oil-handling to new personnel as discussed in the SPCC Plan regarding the following: 1. The operation and maintenance of equipment to prevent discharges. 2.
