Stuart Manager Erik Sandoval stated <br />that Stuart has not been with the company since before Erik became an employee there in January 2023. <br />-The Emergency Contact List has Matthew Nickum listed as the facility Manger. The current facility manager is Erik <br />Sandoval. <br />REGULATION GUIDANCE: The SPCC plan shall include: (vi) Contact list and phone numbers for the facility response <br />coordinator, National Response Center, cleanup contractors with whom you have an agreement for response, and all <br />appropriate Federal, State, and local agencies who must be contacted in case of a discharge as described in § <br />112.1(b). <br />CORRECTIVE ACTION: Immediately amend the SPCC Plan to update the contact list and phone numbers for <br />reporting a discharge. Submit proof of correction to the EHD. <br />This is (Minor) Violation. <br />Code of Fed Regulations 112.7(c) 4030037 - Appropriate (general) containment/diversionary structures/equipment have <br />been provided. <br />OBSERVATION: The facility failed to provide materials discussed in the SPCC Plan (soil/absorbent materials) to erect <br />a temporary dam in the drainage ditch in the event that an uncontained release from AST -1 is headed towards the <br />ditch. The materials discussed were not observed on site at the time of inspection. <br />REGULATION GUIDANCE: (c) Provide appropriate containment and/or diversionary structures or equipment to prevent <br />a discharge as described in § 112.1(b), except as provided in paragraph (k) of this section for qualified oil-filled <br />operational equipment, and except as provided in § 112.9(d)(3) for flowlines and intra-facility gathering lines at an oil <br />production facility. The entire containment system, including walls and floor, must be capable of containing oil and <br />must be constructed so that any discharge from a primary containment system, such as a tank, will not escape the <br />containment system before cleanup occurs. In determining the method, design, and capacity for secondary <br />containment, you need only to address the typical failure mode, and the most likely quantity of oil that would be <br />discharged. Secondary containment may be either active or passive in design. At a minimum, you must use one of <br />the following prevention systems or its equivalent: (1) For onshore facilities: (i) Dikes, berms, or retaining walls <br />sufficiently impervious to contain oil ; (ii) Curbing or drip pans; (iii) Sumps and collection systems; (iv) Culverting, <br />gutters, or other drainage systems; (v) Weirs, booms, or other barriers; (vi) Spill diversion ponds; (vii) Retention <br />ponds; or (viii) Sorbent materials. <br />CORRECTIVE ACTION: Immediately provide materials to erect diversionary structures capable of containing oil and <br />constructed so that any discharge will not escape the containment system before cleanup occurs for AST -1. Submit <br />proof of correction to the EHD. <br />This is (Class 2) Violation. <br /> 24 <br />Code of Fed Regulations 112.7(f)(1) 4020001 - Training provided for op/maint of equip, discharge procedures, <br />laws/regs, general fac ops, and SPCC. <br />OBSERVATION: Facility failed to provide training to oil-handling to new personnel as discussed in the SPCC Plan <br />regarding the following: <br />1. The operation and maintenance of equipment to prevent discharges. <br />2.
