The contents of the SPCC Plan. <br />The SPCC Plan states that records of spill prevention training for new personnel must be kept using the form provided <br />in Attachment C and maintained on site with the SPCC Plan for at least five years . No records of spill prevention <br />training were observed on site at the time of inspection. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance of <br />equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of the <br />training log and training content to the EHD. <br />This is (Class 2) Violation. <br />Code of Fed Regulations 112.7(f)(2) 4010022 - Person has been designated as accountable for discharge prevention <br />and reports to management. <br />OBSERVATION: This facility does not have a designated person for discharge prevention -In the Personnel, Training <br />and Spill Prevention Procedures, the SPCC Plan lists Stuart Davidson as the Spill Prevention Manager. Manager Erik <br />Sandoval stated that Stuart has not been employed with the company since before Erik became employed there in <br />January 2023. <br />REGULATION GUIDANCE: (f)(2) Designate a person at each applicable facility who is accountable for discharge <br />prevention and who reports to facility management. <br />CORRECTIVE ACTION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall designate a person at <br />the facility who is accountable for discharge prevention and who reports to facility management. Designate a person <br />accountable for discharge prevention, submit proof of correction to the EHD. <br />This is (Class 2) Violation. <br /> 31 <br />Code of Fed Regulations 112.7(f)(3) 4020002 - Spill prevention briefings are conducted annually. <br />OBSERVATION: Failure to conduct spill prevention briefing for oil-handling personnel at least once a year as <br />discussed in the SPCC Plan to assure adequate understanding of the SPCC Plan, including: <br />1. Known discharges or failures. <br />2. Malfunctioning components. <br />3. Any recently developed precautionary measures. <br />The SPCC Plan states that records of annual briefings must be kept using the form provided in Attachment C and <br />maintained on site with the SPCC Plan for at least five years. No records of annual briefings were observed on site at <br />the time of inspection. <br />REGULATION GUIDANCE: (f)(3) Schedule and conduct discharge prevention briefings for your oil-handling personnel <br />at least once a year to assure adequate understanding of the SPCC Plan for that facility.
