Environmental Health Department
CP22 - AST Non-Qualified Inspection Report
Date:
June 14, 2024
Facility Address:
4900 E Mariposa RD, Stockton
Facility Name:
Inter-State Oil Co. - Stockton Cardlock
SUMMARY OF VIOLATIONS
(CLASS I, CLASS II, or MINOR - Notice to Comply)
RemarksItem #
This is a repeat violation (Class 2) Violation.
Code of Fed Regulations 112.7(a)(3)(iii) 4010027 - Facility drainage or drainage controls adequately discussed.
OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not adequately discuss facility
drainage or drainage controls.
-Recommendations made by Apex to design and implement procedures to utilize storm drain covers during transfer
activities have been explicitly adopted in the SPCC Plan.
-The plan does not describe where drainage from the AST secondary containment goes after being manually released
using the drain valve.
REGULATION GUIDANCE: Failure to adequately discuss facility drainage, or no discussion of facility drainage
included within the SPCC plan. 40 CFR 112.8(b); HSC 6.67 25270.4.5(a).
CORRECTIVE ACTION: Immediately amend the SPCC Plan to include adequate descriptions of drainage controls and
procedures for facility drainage. Submit proof of correction to the EHD.
This is (Minor) Violation.
41
Code of Fed Regulations 112.8(b)(1) 4030035 - Facility drainage adequately restrained unless conditions met.
OBSERVATION: Failed to adequately use valves to restrain drainage from diked storage areas and/or failed to inspect
the condition of accumulation before draining.
-Drainage valve for the AST secondary containment was observed to be in the open position at the time of inspection .
REGULATION GUIDANCE: (1) Restrain drainage from diked storage areas by valves to prevent a discharge into the
drainage system or facility effluent treatment system , except where facility systems are designed to control such
discharge. You may empty diked areas by pumps or ejectors ; however, you must manually activate these pumps or
ejectors and must inspect the condition of the accumulation before starting, to ensure no oil will be discharged.
CORRECTIVE ACTION: Ensure that drainage valves remain closed to prevent discharge from diked areas, only use
manually activated pumps to empty diked areas, and inspect the condition of accumulated liquids (to ensure no oil will
be discharged) prior to draining. Submit proof of correction to the EHD.
This is (Minor) Violation.
42
Code of Fed Regulations 112.8(c)(3)(iv) 4010026 - Records maintained of drainage from diked areas.
OBSERVATION: Adequate records of drainage of uncontaminated rainwater from diked areas of drainage were not
found on site. No drainage records were observed on-site at the time of inspection.
REGULATION GUIDANCE: (c)(3)(iv) Keep adequate records of such events, for example, any records required under
permits issued in accordance with §§ 122.41(j)(2) and 122.41(m)(3) of this chapter.
CORRECTIVE ACTION: Immediately begin maintaining adequate records (or NPDES permit records) of drainage from
diked areas. Submit proof of correction to the EHD.
This is a repeat violation (Class 2) Violation.
52
Code of Fed Regulations 112.7(e), 112.8(c)(6) 4030015 - Aboveground containers tested or inspected for integrity 56
FA0014269 PR0530044 SC001 06/14/2024
EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 10 of 13
1868 E.
