Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />June 14, 2024 <br /> Facility Address: <br /> 4900 E Mariposa RD, Stockton <br /> Facility Name: <br /> Inter-State Oil Co. - Stockton Cardlock <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />This is a repeat violation (Class 2) Violation. <br />Code of Fed Regulations 112.7(a)(3)(iii) 4010027 - Facility drainage or drainage controls adequately discussed. <br />OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not adequately discuss facility <br />drainage or drainage controls. <br />-Recommendations made by Apex to design and implement procedures to utilize storm drain covers during transfer <br />activities have been explicitly adopted in the SPCC Plan. <br />-The plan does not describe where drainage from the AST secondary containment goes after being manually released <br />using the drain valve. <br />REGULATION GUIDANCE: Failure to adequately discuss facility drainage, or no discussion of facility drainage <br />included within the SPCC plan. 40 CFR 112.8(b); HSC 6.67 25270.4.5(a). <br />CORRECTIVE ACTION: Immediately amend the SPCC Plan to include adequate descriptions of drainage controls and <br />procedures for facility drainage. Submit proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 41 <br />Code of Fed Regulations 112.8(b)(1) 4030035 - Facility drainage adequately restrained unless conditions met. <br />OBSERVATION: Failed to adequately use valves to restrain drainage from diked storage areas and/or failed to inspect <br />the condition of accumulation before draining. <br />-Drainage valve for the AST secondary containment was observed to be in the open position at the time of inspection . <br />REGULATION GUIDANCE: (1) Restrain drainage from diked storage areas by valves to prevent a discharge into the <br />drainage system or facility effluent treatment system , except where facility systems are designed to control such <br />discharge. You may empty diked areas by pumps or ejectors ; however, you must manually activate these pumps or <br />ejectors and must inspect the condition of the accumulation before starting, to ensure no oil will be discharged. <br />CORRECTIVE ACTION: Ensure that drainage valves remain closed to prevent discharge from diked areas, only use <br />manually activated pumps to empty diked areas, and inspect the condition of accumulated liquids (to ensure no oil will <br />be discharged) prior to draining. Submit proof of correction to the EHD. <br />This is (Minor) Violation. <br /> 42 <br />Code of Fed Regulations 112.8(c)(3)(iv) 4010026 - Records maintained of drainage from diked areas. <br />OBSERVATION: Adequate records of drainage of uncontaminated rainwater from diked areas of drainage were not <br />found on site. No drainage records were observed on-site at the time of inspection. <br />REGULATION GUIDANCE: (c)(3)(iv) Keep adequate records of such events, for example, any records required under <br />permits issued in accordance with §§ 122.41(j)(2) and 122.41(m)(3) of this chapter. <br />CORRECTIVE ACTION: Immediately begin maintaining adequate records (or NPDES permit records) of drainage from <br />diked areas.
