CORRECTIVE ACTION: Immediately conduct the necessary integrity testing and inspection on the two 250 gal tank, one 350 gal tank, and one 12,000 gal tank based on industry standards, on a regular schedule, after making material repairs, using non-destructive testing, inspecting each container's supports,foundations, and outside for signs of deterioration, discharges,or accumulation of oil inside diked areas. Maintain testing and inspection records. Submit a copy of the test/inspection results to the EHD. This is (Class 2)Violation. 57 Code of Fed Regulations 112.7(e), 112.8(c)(6)4010021 -Written Inspection/testing procedures kept, inspection/testing records signed, kept for 3 years. OBSERVATION:The facility failed to keep written procedures and records of inspections and tests, including integrity tests,for at least three years. Copies of inspection and testing records for 2022, 2023, 2024 were not found on site. REGULATION GUIDANCE: 112.7(e), Conduct inspections and tests required by this part in accordance with written procedures that you or the certifying engineer develop for the facility. You must keep these written procedures and a record of the inspections and tests, signed by the appropriate supervisor or inspector,with the SPCC Plan for a period of three years. Records of inspections and tests kept under usual and customary business practices will suffice for purposes of this paragraph.11 2.8(c)(6)Test or inspect each aboveground container for integrity on a regular schedule and whenever you make material repairs. CORRECTIVE ACTION: Inspections and tests must be conducted in accordance with the written procedures developed in the Spill Prevention, Control, and Countermeasure(SPCC)Plan. Records of these inspections and tests must be signed by the appropriate supervisor or inspector and kept on-site with the SPCC Plan for three years. Immediately locate a copy of all inspection and testing records for the last three years, maintain them on-site, and submit copies to the EHD. This is (Class 2)Violation. Overall Inspection Comments: An inspection checklist was provided to the facility operator on the day of inspection. A complete report was finished on 5/22/2024 and replaces the initial checklist. Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, within 30 days of receiving the complete inspection report. To minimize person to person contact EHD is choosing to write the name of person receiving the report instead of having them sign.
