Records of inspections and tests kept under usual and customary business practices will suffice for purposes of this paragraph. 112.8(c)(6) Test or inspect each aboveground container for integrity on a regular schedule and whenever you make material repairs. CORRECTIVE ACTION: Inspections and tests must be conducted in accordance with the written procedures developed in the Spill Prevention, Control, and Countermeasure (SPCC) Plan. Records of these inspections and tests must be signed by the appropriate supervisor or inspector and kept on-site with the SPCC Plan for three years. Immediately locate a copy of all inspection and testing records for the last three years, maintain them on-site, and submit copies to the EHD. This is (Class 2) Violation. CA Health and Safety Code 25270.6(a) 4010032 - Tank Facility Statement or Business Plan has been submitted . OBSERVATION: A complete tank facility statement or a business plan has not been submitted on 2024 and 2022. REGULATION GUIDANCE: (a)(1) On or before January 1, annually, each owner or operator of a tank facility subject to this chapter shall file with the statewide information management system, a tank facility statement that shall identify the name and address of the tank facility, a contact person for the tank facility, the total storage capacity of the tank facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage capacity. A copy of a statement submitted previously pursuant to this section may be submitted in lieu of a new tank facility statement if no new or used storage tanks have been added to the facility or if no significant modifications have been made. For purposes of this section, a significant modification includes, but is not limited to, altering existing storage tanks or changing spill prevention or containment methods. (2) Notwithstanding paragraph (1), an owner or operator of a tank facility that submits a business plan, as defined in subdivision (d) of Section 25501 , to the statewide information management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , 25507.2 , 25508 , 25508.1 , and 25508.2 , satisfies the requirement in paragraph (1) to file a tank facility statement. CORRECTIVE ACTION: Immediately submit a complete and adequate tank facility statement or a business plan. Submit proof of correction to the EHD. This is (Minor) Violation. 74 Code of Fed Regulations 112.20(e) 4010044 - Substantial Harm Criteria certification maintained at the facility as required. OBSERVATION: The facility failed to complete and maintain (at the facility) the Substantial Harm Criteria certification form, and the owner/or operator JC Air Academy determined that the facility could not be reasonably expected to cause substantial harm to the environment. REGULATION GUIDANCE: (e) If the owner or operator of a facility determines pursuant to paragraph (a)(2) of this section that the facility could not, because of its location, reasonably be expected to cause substantial harm to the environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator shall complete and maintain at the facility the certification form contained in appendix C to this part and, in the event an alternative formula that is comparable to one contained in appendix C to this part is used to evaluate the criterion in paragraph (f)(1)(ii)(B) or (f)(1)(ii)(C) of this section, the owner or operator shall attach documentation to the certification form that demonstrates the reliability and analytical soundness of the comparable formula and shall notify the Regional Administrator in writing that an alternative formula was used. 78 FA0023280 PR0544293 SC001 09/03/2024 EHD Rev. 12/06/2021 CP22 - AST Non-Qualified OIRPage 8 of 9 1868 E.
