Environmental Health Department <br />CP22 - AST Tier I Inspection Report <br />Date: <br />August 13, 2024 <br /> Facility Address: <br /> 3400 AUTO PLAZA WAY, TRACY <br /> Facility Name: <br /> TRACY CHEVROLET <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />with a section cross-referencing the location of requirements listed in this part and the equivalent requirements in the <br />other prevention plan. If the Plan calls for additional facilities or procedures, methods, or equipment not yet fully <br />operational, you must discuss these items in separate paragraphs and must explain separately the details of <br />installation and operational start-up. <br />CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility. Provide <br />proof of correction to the EHD. <br />This is (Minor) Violation. <br />Code of Fed Regulations 112.1(b)(3), 112.2 4030036 - All/any permanently closed tanks are properly closed under the <br />definition in 40 CFR 112.2. <br />OBSERVATION: Observed a white tank at the north parking lot near the hazardous waste storage area with no <br />permanently closed sign. According to Mr. Sam Balanon (Service Manager) the tank has been closed since a couple <br />years ago and not in use. The connecting piping and valves were closed but no "Permanently closed "sign posted. <br />REGULATION GUIDANCE: When a tank is not in use, it must be permanently closed by meeting the following <br />conditions: - remove all liquid and sludge from each container and connecting line - disconnect and blank off <br />all connecting lines and piping have from the tank/ container - close and lock all valves - post a sign <br />conspicuously stating that it is a permanently closed container and denoting the date of closure. <br />CORRECTIVE ACTION: Tanks that are not being used or are not addressed in the Spill Prevention , Control, and <br />Countermeasure (SPCC) Plan must either be included in your plan or meet the permanent closure requirements noted <br />above. Provide verification to the EHD of proper closure of the tanks. <br />This is a repeat violation (Class 2) Violation. <br /> 50 <br />CA Health and Safety Code 25404(e)(4) 4010 - Administration/Documentation - General. <br />OBSERVATION: A submission to the California Environmental Reporting System (CERS) for the Aboveground <br />Petroleum Storage Act (APSA) program made on 12/21/2023 stated the incorrect date of SPCC plan certification as <br />10/30/2014. <br />REGULATION GUIDANCE: 25404(e)(4) No later than three years after the statewide information management system <br />is established, each CUPA, PA, and regulated business shall report program data electronically. The secretary shall <br />work with the CUPAs to develop a phase -in schedule for the electronic collection and submittal of information to be <br />included in the statewide information management system, giving first priority to information relating to those <br />chemicals determined by the secretary to be of greatest concern. The secretary, in making this determination shall <br />consult with the CUPAs, the California Emergency Management Agency , the State Fire Marshal, and the boards, <br />departments, and offices within the California Environmental Protection Agency . <br />CORRECTIVE ACTION: Beginning January 1, 2013, all businesses are required to submit all new (or any changes to <br />existing) Aboveground Petroleum Storage Act (APSA) information online to the CERS at http://cers.calepa.ca.gov. Be <br />sure to include your APSA activity in the Businesses Activities section in CERS in addition to any other relevant <br />activities and required fields.
