OBSERVATION: At the time of inspection, it could not be demonstrated (not necessarily documented) that employees who handle hazardous waste were properly trained. The training documents received shows that some staff have a progress of 0 percent. In addition, the training did not show that the training requirements (see regulation guidance) was taught. No information was also given on the training of the imamates. REGULATION GUIDANCE: The business owner must ensure that all employees are thoroughly familiar with proper waste handling and emergency procedures, relevant to their responsibilities during normal facility operations and emergencies. CORRECTIVE ACTION: Immediately train the employees (and inmates that work with/generate hazardous waste). Provide proof of training within 30 days to the San Joaquin County Environmental Health Department (EHD) for employees whose responsibilities include hazardous waste. This is a repeat violation (Class 2) Violation. 2 CA Code of Regulations 66262.42(a)(c)(d) 3010030 - Completed all Uniform Hazardous Waste Manifest exception reporting requirements. OBSERVATION: The facility did not have exception reports on site for Uniform Hazardous Waste Manifests (UHWM): 017231597FLE (11/29/2022), 017231598FLE (11/29/2022), 017231602FLE (11/29/2022), 018217005FLE (2/14/2024), 018217007FLE (2/14/2024), 018217008FLE (2/14/2024), and 018217523FLE (8/7/2024). REGULATION GUIDANCE: (a) A generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the designated facility within 35 days of the date the waste was accepted by the initial transporter shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the hazardous waste. (c) A hazardous waste generator who does not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste is submitted, within 60 days from the date that the hazardous waste was accepted by the initial transporter, shall submit to the department a legible copy of the manifest, with some indication that the generator has not received confirmation of delivery. (d) Generators shall submit the information to the department at: DTSC Report Repository, Generator Information Services Section, P.O. Box 806, Sacramento, CA 95812-0806 CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department (EHD).
