Environmental Health Department <br />AMENDED <br />11/27/2024 <br />CP22 - HW SQG Inspection Report <br />Date: <br />September 25, 2024 <br /> Facility Address: <br /> 7707 Austin RD, Stockton <br /> Facility Name: <br /> CDCR-California Health Care Facility <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />then send to DTSC a copy of each generator signed manifest and a statement that the designated facility signed copy <br />was not received by the generator. DTSC address is DTSC Report Repository, Generator Information Services <br />Section, PO Box 806, Sacramento, CA 95812-0806. Provide a corrective action statement to the EHD within 30 <br />days. <br />This is a repeat violation (Class 2) Violation. <br />CA Code of Regulations 66262.40(a) 3010010 - Signed copy of Uniform Hazardous Waste Manifest kept for 3 years. <br />OBSERVATION 1: The business operator could not provide hazardous waste disposal records for the past three years <br />during the inspection. The following manifests were missing from the document review 011961924FLE (5/5/2022), <br />016408878FLE (5/5/2022), 016408886FLE (5/5/2022) and 016409253FLE (7/18/2022). <br />OBSERVATION 2: Designated facility signed and dated copies of Uniform Hazardous Waste Manifests (UHWM) were <br />not found on-site. The missing manifests are: 017231597FLE (11/29/2022), 017231598FLE (11/29/2022), <br />017231602FLE (11/29/2022), 018217005FLE (2/14/2024), 018217007FLE (2/14/2024), 018217008FLE (2/14/2024), <br />and 018217523FLE (8/7/2024). <br /> <br />REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance <br />with section 66262.23(a) for three years or until the generator receives a signed copy from the designated facility <br />which received the waste. This signed copy shall be retained as a record for at least three years from the date the <br />waste was accepted by the initial transporter. <br />CORRECTIVE ACTION: Provide a copy of the manifests (completed and sighed by the TSDF) listed in observations 1 <br />and 2. Provide these records and a corrective action statement to the EHD within 30 days. <br />This is a repeat violation (Class 2) Violation. <br /> 6 <br />CA Code of Regulations 66262.11 3030005 - Determined if waste generated is hazardous waste. <br />Location: CDCR-NORTHERN CALIFORNIA YOUTH CORRECTIONAL CENTER <br />OBSERVATIONS: Metal fines were observed in an open trash can in the maintenance shop. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as <br />specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous wastes. <br />There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or <br />ignitable. Metal particles 100 microns or smaller in size must be handled and disposed of as hazardous waste if the <br />metal is determined to be a hazardous waste. Metal particles larger than 100 microns in size can be recycled as <br />scrap metal. <br />CORRECTIVE ACTION: Immediately make a hazardous waste determination for the metal fines and manage them <br />according to Title 22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other knowledge to <br />make your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR. <br />Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current <br />storage and labeling for wastes determined to be hazardous wastes.
