The designated operator on site,the cashier, and owner all stated they had not <br /> opened the sump recently and no alarms were listed on the alarm history. <br /> REGULATION GUIDANCE: Monitoring equipment shall be maintained to be able to detect a leak at the earliest <br /> possible opportunity. <br /> CORRECTIVE ACTION: The sensor was relocated to the lowest point of the sump by the service technician. Ensure <br /> that all monitoring equipment is maintained and located to detect a leak at the earliest opportunity. <br /> This is(Class 2)Violation. <br /> 53 CA Health and Safety Code 25292.2; CCR 2711(a)(11)2010007-Submitted/maintained current Cert of Financial <br /> Responsibility/mech of financial assurance(TCR 11). <br /> OBSERVATION: The most recent financial responsibility documents observed on site are dated 5/17/19. <br /> REGULATION GUIDANCE: Current financial responsibility documents are required to be submitted annually. <br /> CORRECTIVE ACTION: Immediately obtain a copy of the updated financial responsibility documents and retain on <br /> site. <br /> This is a repeat violation(Class 2) Violation. <br /> 56 CA Code of Regulations 2716(a-e)2030013-DO inspections completed at least every 30 days and meet all <br /> requirements(TCR 12). <br /> OBSERVATION: The designated UST operator visual inspection reports did not meet all requirements. <br /> -Designated operator reports were not signed within the required time frame. The 11/29/24 designated operator report <br /> was not signed or dated by the owner/operator. <br /> -The designated operator ICC certification expiration date was not updated and listed an expiration date of 2/22/24 on <br /> the 7/10/24,8/9/24,9/6/24, 10/3/24, and 11/1/24 visual inspection reports. <br /> REGULATORY GUIDANCE:Within 48 hours of the completion of the designated UST operator visual inspection, the <br /> designated operator shall sign and provide the owner or operator with a copy of the inspection report. Within 72 hours <br /> of being provided a signed copy of the report, the owner or operator shall provide a description of each corrective action <br /> taken or to be taken and shall sign and date the report, acknowledging the identified compliance issues. <br /> CORRECTIVE ACTION: Ensure all designated operator inspection reports are completed and signed within the <br /> required time frame in the future and all information is up to date on each report. <br /> This is a repeat violation(Class 2) Violation. <br /> 59 CA Code of Regulations 2712(b)(1-2)2030001 -Records of release detection monitoring and maintenance properly <br /> maintained(TCR 9d). <br /> OBSERVATION: Maintenance and monitoring records for the last three years were not found on site. <br /> -Monitoring System Certification results from 1/29/24 <br /> -Spill Container test results from 1/29/24 <br /> REGULATION GUIDANCE: These records shall be maintained on site for at least three years.
