DBA Escalon Arco 1329 ESCALON AVE, ESCALON June 25 2025 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> the previous inspection. <br /> CORRECTIVE ACTION: Ensure that all designated operator inspections are performed within the required time frames. <br /> This is a repeat violation (Class 2) Violation. <br /> 72 CA Code of Regulations 2712 2030039-Compliance with all operating permit requirements. <br /> OBSERVATION:The facility is not in compliance with the written conditions of its underground storage tank(UST) <br /> operating permit.The routine monitoring system certification was scheduled for February 17, 2025, a recognized <br /> holiday.As a result, no inspector was present to conduct or verify the certification. <br /> An additional inspection was scheduled for May 20, 2025,to verify sump conditions; however,this appointment was <br /> cancelled.The inspection was to be rescheduled for June, in conjunction with the Air Quality inspection, but no <br /> notification of rescheduling or subsequent inspection was received by the regulatory agency. <br /> In accordance with California Health and Safety Code Division 20, Chapter 6.7, Section 25288 and California Code of <br /> Regulations Title 23, Section 2712, annual inspections are required to ensure compliance with applicable operational, <br /> monitoring, and testing standards, as well as to verify overall system integrity and safety. <br /> REGULATION GUIDANCE:The owner and operator of underground storage tank(UST)systems shall comply with all <br /> requirements of the permit issued for the operation of the UST system. Cal. Health &Safety Code Div. 20, Ch. 6.7, § <br /> 25288. (CCR)Title 23§?2712. <br /> CORRECTIVE ACTION: Immediately take all necessary actions to bring these UST systems into compliance. <br /> This is (Minor)Violation. <br /> 77 CA Code of Regulations 2712(f)2030073- Facility has corrected cited violations within 30 days of receiving report. <br /> OBSERVATION:An inspection was last done on 2/14/2024 and an inspection report was issued identifying information <br /> to be submitted to bring this site into compliance. This information was required to be submitted by 3/15/2024. This <br /> information has not been received resulting in a non-compliant status for this facility. <br /> REGULATION GUIDANCE:An operator that receives an inspection report shall have 30 days to submit a written <br /> response that includes a statement documenting corrective actions taken or proposing corrective actions which will be <br /> taken. <br /> CORRECTIVE ACTION: Ensure that a written response documenting corrective actions taken or proposed is <br /> submitted within 30 days of receiving an inspection report.
