Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />September 25, 2024 <br /> Facility Address: <br /> 7707 Austin RD, Stockton <br /> Facility Name: <br /> CDCR-California Health Care Facility <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />most likely quantity of discharge for the generators located at the NCYCC facility. <br />The plan also did not discuss if the secondary containment provided to the used oil tank was adequate (located in <br />NCYCC facility). <br />REGULATION GUIDANCE: (c) Provide appropriate containment and/or diversionary structures or equipment to prevent <br />a discharge as described in § 112.1(b), except as provided in paragraph (k) of this section for qualified oil-filled <br />operational equipment, and except as provided in § 112.9(d)(3) for flowlines and intra-facility gathering lines at an oil <br />production facility. <br />CORRECTIVE ACTION: Immediately ensure that the SPCC plan addresses the general containment, diversionary <br />structures, and equipment in use at the facility to prevent discharge, including typical failure mode and most likely <br />quantity of potential discharge. Submit proof of correction to the EHD. <br />This is a repeat violation (Class 2) Violation. <br />Code of Fed Regulations 112.7(f)(1) 4020001 - Training provided for op/maint of equip, discharge procedures, <br />laws/regs, general fac ops, and SPCC. <br />OBSERVATION: Oil handling personnel were not adequately trained as required. <br /> Training sheets reviewed had blank signatures for employees indicating they were not trained (both CHCF and <br />NCYCC). In addition, the APSA training received from NCYCC for review was dated 10/9/2024. This training was given <br />after the site visit. <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance of <br />equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. <br />CORRECTIVE ACTION: Immediately provide adequate training to all oil handling personnel and submit a copy of the <br />training log and training content to the EHD. <br />This is a repeat violation (Class 2) Violation. <br /> 30 <br />Code of Fed Regulations 112.7(f)(2) 4010022 - Person has been designated as accountable for discharge prevention <br />and reports to management. <br />OBSERVATION: This facility does not have a designated person for discharge prevention. Section 10.1.2 of the plan <br />references the designated person being listed in section 2.5. Section 2.5 was not observed in the plan. <br />REGULATION GUIDANCE: (f)(2) Designate a person at each applicable facility who is accountable for discharge <br />prevention and who reports to facility management. <br />CORRECTIVE ACTION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan shall designate a person at <br />the facility who is accountable for discharge prevention and who reports to facility management.
