OBSERVATION: Facility could not provide the Emergency Response Plan and the inventory information upon request. Employees do not have access to the Emergency Response Plan and the inventory information on-site. REGULATION GUIDANCE: The emergency response plans and procedures, the inventory of information required by this article, and the site map required by this section shall be readily available to personnel of the business or the unified program facility with responsibilities for emergency response or training pursuant to this section. CORRECTIVE ACTION: Immediately make arrangements to have the business plan readily available for review. This is (Minor) Violation. 4 CA Health and Safety Code 25508.2 1010008 - Business plan reviewed and electronically certified as complete/accurate on or before the due date. OBSERVATION: The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS) annually by the due date, January 15. The business plan was not submitted for the years of 2016, 2019, and 2020. The business plan was submitted late on 11/8/2017. The business plan was submitted late on 12/31/2021 for the year of 2021. the business plan was summited late on 2/16/2023 for the year of 2023. The submittal was made on time for the year of 2024. This violation was corrected on site. REGULATION GUIDANCE: The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year CORRECTIVE ACTION: Submit a statement to SJC EHD stating that the business will annually certify/submit the annual HMBP to CERS by January 15. This is a repeat violation (Class 2) Violation. 10 CA Health and Safety Code 25505(a)(1) 1010004 - Complete and accurate Hazardous Materials Inventory information electronically submitted. OBSERVATION: The Hazardous Materials Inventory forms for carbon dioxide were not complete. Obsolete federal hazard categories were submitted. Discard obsolete federal hazard categories and add new ones using an updated safety data sheet. REGULATION GUIDANCE :The Hazardous materials inventory information must be current and submitted as part of the business plan. CORRECTIVE ACTIONS: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
