OBSERVATION:The Spill Prevention, Control, and Countermeasure(SPCC)Plan was not implemented, as required. In the Bulk containment area there were five empty 55 gallon drums when only four were listed on the SPCC plan. There were also 2 tire rims and a black plastic bin with in the bulk containment area. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan (hereafter"SPCC Plan"or "Plan")," in accordance with § 112.7 and any other applicable section. 25270.4.5.(a):An owner or operator shall conduct periodic inspections of the storage tank to ensure compliance with Part 112 (commencing with Section 112.1) of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. In implementing the spill prevention control and countermeasure plan, an owner or operator shall fully comply with the latest version of the regulations contained in Part 112 (commencing with Section 112.1)of Subchapter D of Chapter I of Title 40 of the Code of Federal Regulations. CORRECTIVE ACTION: Implement the SPCC plan, as required. Submit proof of correction to the EHD. This is (Class 2)Violation. 29 Code of Fed Regulations 112.7(f)(1), 112.7(f)(3)4010023-Employee training and spill prevention briefings discussed in SPCC plan. OBSERVATION: Failure to include in the Spill Prevention, Control, and Countermeasure(SPCC)Plan a discussion, or adequate description of all required employee training including annual spill prevention briefings provided to oil-handling personnel. Failure to use the provided Spill Prevention Briefing Form and the SPCC Annual Training form for employee training. REGULATION GUIDANCE: (f)(1)At a minimum,train your oil-handling personnel in the operation and maintenance of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and regulations;general facility operations; and,the contents of the facility SPCC Plan. (f)(3)Schedule and conduct discharge prevention briefings for your oil-handling personnel at least once a year to ensure an adequate understanding of the SPCC Plan for that facility. Such briefings must highlight and describe known discharges as described in§ 112.1(b)or failures, malfunctioning components, and any recently developed precautionary measures. CORRECTIVE ACTION: The SPCC Plan shall include an adequate description of employee training. Training shall address, at a minimum: operation and maintenance of equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility operations; content of the facility SPCC plan; and annual discharge prevention briefings for oil-handling personnel to assure adequate understanding of the SPCC plan. Provide proof of correction to the EHD.
