A dOAQU1N Environmental Health Department <br /> CQLJIVTY AMENDED <br /> 2/25/2025 <br /> CP22 - AST Non-Qualified Inspection Report <br /> Facility Name: Facility Address: Date: <br /> RALPH HAYES&SON INC 20177 S MACARTHUR DR, TRACY February 24 2025 <br /> SUMMARY OF VIOLATIONS <br /> (CLASS I,CLASS II,or MINOR-Notice to Comply) <br /> Item# Remarks <br /> Approximately 2 inches of liquid with visible rainbow sheen within the secondary containment area. <br /> REGULATION GUIDANCE: (c)(10)Promptly correct visible discharges which result in a loss of oil from the container, <br /> including but not limited to seams,gaskets, piping, pumps,valves, rivets, and bolts. You must promptly remove any <br /> accumulations of oil in diked areas. <br /> CORRECTIVE ACTION: Immediately remove all accumulation of contaminated liquid from within the secondary <br /> containment area, and manage all wastes according to the California Code of Regulations Title 22 hazardous waste <br /> regulations, submit proof of correction to the EHD. <br /> This is (Class 2)Violation. <br /> 74 CA Health and Safety Code 25270.6(a)4010032-Tank Facility Statement or Business Plan has been submitted. <br /> OBSERVATION:A complete 2025 tank facility statement or a business plan has not been submitted into CERS. <br /> REGULATION GUIDANCE: (a)(1)On or before January 1, annually, each owner or operator of a tank facility subject to <br /> this chapter shall file with the statewide information management system, a tank facility statement that shall identify <br /> the name and address of the tank facility, a contact person for the tank facility,the total storage capacity of the tank <br /> facility, and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage <br /> capacity. A copy of a statement submitted previously pursuant to this section may be submitted in lieu of a new tank <br /> facility statement if no new or used storage tanks have been added to the facility or if no significant modifications have <br /> been made. For purposes of this section, a significant modification includes, but is not limited to, altering existing <br /> storage tanks or changing spill prevention or containment methods. (2) Notwithstanding paragraph (1), an owner or <br /> operator of a tank facility that submits a business plan, as defined in subdivision (d)of Section 25501 ,to the <br /> statewide information management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , <br /> 25507.2 , 25508 , 25508.1 , and 25508.2 , satisfies the requirement in paragraph (1)to file a tank facility statement. <br /> CORRECTIVE ACTION: Immediately submit a complete and adequate tank facility statement or a business plan. <br /> Submit proof of correction to the EHD. <br /> This is (Class 2)Violation. <br /> 78 Code of Fed Regulations 112.20(e)4010044-Substantial Harm Criteria certification maintained at the facility as <br /> required. <br /> OBSERVATION:The facility failed to complete and maintain (at the facility)a signed copy of the Substantial Harm <br /> Criteria certification form. <br /> REGULATION GUIDANCE: (e) If the owner or operator of a facility determines pursuant to paragraph (a)(2)of this <br /> section that the facility could not, because of its location, reasonably be expected to cause substantial harm to the <br /> environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator shall <br /> complete and maintain at the facility the certification form contained in appendix C to this part and, in the event an <br /> alternative formula that is comparable to one contained in appendix C to this part is used to evaluate the criterion in <br /> paragraph (f)(1)(ii)(B)or(f)(1)(ii)(C)of this section,the owner or operator shall attach documentation to the certification <br /> form that demonstrates the reliability and analytical soundness of the comparable formula and shall notify the Regional <br /> Administrator in writing that an alternative formula was used. <br /> FA0009323 PR0545958 SCO01 02/24/2025 <br /> EHD Rev.12/06/2021 Page 6 of 7 CP22-AST Non-Qualified OIR <br /> 1868 E.
