The following is an itemized list of hazardous materials violations that have not been addressed for CALCHEF FOODS, LLC DBA KEVIN'S NATURAL FOODS as of February 24, 2025. Open violations from April 04, 2024 inspection Violation #2 - Failed to initially complete and electronically submit a hazardous materials business plan (HMBP). OBSERVATION: Business has been storing onsite reportable quantities of hazardous materials since 2023 and observed on 4/4/24 and has not submitted a complete Hazardous Materials Business Plan electronically to the California Environmental Reporting System (CERS). REGULATION GUIDANCE: As of January 1, 2013, all businesses were required to submit all business plans electronically. CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. OBSERVATION: A Hazardous Materials Business Plan has not been established or implemented. REGULATION GUIDANCE: A Hazardous Materials Business Plan (HMBP) shall be established and implemented for emergency response to a release or threatened release of a hazardous material when storing hazardous materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or 200 cubic feet for compressed gas, at standard temperature and pressure. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. Describe actions taken or will be taken to correct violation: ¨ This violation will be corrected by (date): ¨ This violation was corrected ¨ Supporting documents included Violation #4 - Failed to electronically submit the Business Activities or Owner/Operator Identification page. OBSERVATION: The Business Owner/Operator Identification form was not submitted or complete. CERS has not yet been completed by the facility. REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
