The following is an itemized list of hazardous materials violations that have not <br />been addressed for CALCHEF FOODS, LLC DBA KEVIN'S NATURAL FOODS as <br />of February 24, 2025. <br />Open violations from April 04, 2024 inspection <br />Violation #2 - Failed to initially complete and electronically submit a hazardous materials business plan <br />(HMBP). <br />OBSERVATION: Business has been storing onsite reportable quantities of hazardous materials since 2023 and <br />observed on 4/4/24 and has not submitted a complete Hazardous Materials Business Plan electronically to the <br />California Environmental Reporting System (CERS). <br />REGULATION GUIDANCE: As of January 1, 2013, all businesses were required to submit all business plans <br />electronically. <br />CORRECTIVE ACTION: Immediately log into the CERS at http://cers.calepa.ca.gov/, enter the correct or updated <br />information, and submit to the EHD for approval. <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Violation #3 - Failed to establish and implement a HMBP. <br />OBSERVATION: A Hazardous Materials Business Plan has not been established or implemented. <br />REGULATION GUIDANCE: A Hazardous Materials Business Plan (HMBP) shall be established and implemented <br />for emergency response to a release or threatened release of a hazardous material when storing hazardous <br />materials at or above the thresholds quantities of 55 gallons for materials that are liquids, 500 pounds for solids, or <br />200 cubic feet for compressed gas, at standard temperature and pressure. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the required information, and submit for review by the EHD./Submit a <br />statement/documentations to SJC EHD demonstrating that the HMBP has been established and implemented. <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Violation #4 - Failed to electronically submit the Business Activities or Owner/Operator Identification page. <br />OBSERVATION: The Business Owner/Operator Identification form was not submitted or complete. CERS has not <br />yet been completed by the facility. <br />REGULATION GUIDANCE: This information must be current and submitted as part of the business plan. <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval. <br />Page 1 of 4
