The following is an itemized list of CP22 - HMBP violations that have not been <br />addressed for Olive Garden #1779 as of March 05, 2025. <br />Open violations from October 31, 2024 inspection <br />Violation #12 - 1010010 - Electronically submitted adequate response plan/procedures for <br />release/threatened release of hazmat. <br />OBSERVATION: The emergency response(ER) procedures were lacking or inadequate. <br />-Local CUPA phone number is incorrect <br />-Evacuation assembly area (E3) is blank <br />REGULATION GUIDANCE: A business plan shall include the following emergency response procedures for a release <br />or threatened release of hazardous materials, including, but not limited to, the following: <br />-Immediate notification of local emergency personnel and the Environmental Health Department (EHD) <br />-Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment <br />-Evacuation plans and procedures, including immediate notice, for the site <br />CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at <br />http://cers.calepa.ca.gov/, upload the correct or updated information, and submit to the EHD for approval. <br /> <br />Describe actions taken or will be taken to correct violation: <br />¨ This violation will be corrected by (date): ¨ This violation was corrected <br />¨ Supporting documents included <br />Violation #14 - 1020002 - Provided initial and annual training and maintained training records for a <br />minimum of three years. <br />OBSERVATION: Initial at-hire training records were available on site but no annual refresher training records were <br />observed. <br />REGULATION GUIDANCE: The business plan shall include provisions for ensuring that appropriate personnel receive <br />initial and annual refresher training. All employees shall be trained in safety procedures in the event of a release or <br />threatened release of a hazardous material, including, but not limited to, familiarity with the following plans and <br />procedures: <br />(A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified program <br />agency. <br />(B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br />persons, property, or the environment. <br />(C) Evacuation plans and procedures, including immediate notice, for the business site. <br />This training shall be documented electronically or by hard copy and shall be made available for a minimum of three <br />years. <br />CORRECTIVE ACTION: Immediately provide employee training for appropriate personnel and submit a copy of the <br />training records to the EHD. <br /> <br />Page 2 of 3
