The owner or operator shall maintain training records on current personnel until closure of the facility and training records on former employees for at least three years from the date the employee last worked at the facility. CORRECTIVE ACTION: Immediately train all employees who work with hazardous waste in compliance within the time frames and training materials required by this section. Provide training documentation to the San Joaquin County Environmental Health Department(EHD)within 30 days.The documentation must include a list of training topics,date of training,job title, name of employee,written job description(qualifications and duties), and employee signed(or certified) record that documents the training. This is a repeat violation (Class 2) Violation. 8 CA Code of Regulations 66262.42 3110004-Completed all Uniform Hazardous Waste Manifest exception reporting requirements. OBSERVATION: Destination facility signed copies of uniform Hazardous Waste Manifest (UHWM)was not found on site during the inspection. The facility has not sent an exception report to the California Department of Toxic Substances Control(DTSC)for the destination facility signed UHWM not received within 35 days of shipping the hazardous waste off site. The missing destination signed UHWM is: -024410606JJK(8/21/2023) REGULATION GUIDANCE: Title 22 California Code of Regulations section 66262.42 Exception Reporting CORRECTIVE ACTION: Locate a copy of the destination facility signed manifests and send a copy to the San Joaquin County Environmental Health Department(EHD). If the destination facility signed manifests cannot be found then prepare an exception report for each missing manifest as required by Title 22 California Code of Regulations section 66262.42. The exception report shall include a legible copy of the manifest for which the generator does not have confirmation of delivery and a cover letter signed by the generator or the generator's authorized representative explaining the efforts taken to locate the hazardous waste and the results of those efforts. OBSERVATION: Designated facility signed and dated copies of Uniform Hazardous Waste Manifest (UHWM)was not found on-site. The missing manifests is: -024410606JJK(8/21/2023) REGULATION GUIDANCE: A hazardous waste generator shall keep a copy of each manifest signed in accordance with section 66262.23(a)for three years or until the generator receives a signed copy from the designated facility which received the waste.This signed copy shall be retained as a record for at least three years from the date the waste was accepted by the initial transporter. The hazardous waste generator must submit an exception report to the California Department of Toxic Substances Control (DTSC)within 45 days if the destination facility signed manifest copy is not received from the transporter or designated facility.
