Send a copy to the San Joaquin County Environmental Health Department (EHD). This is a repeat violation (Class 2) Violation. 10 CA Code of Regulations 66262.23(a)(4) 3110006-Sent a legible copy of each Uniform Hazardous Waste Manifest to the DTSC within 30 days of shipment. OBSERVATION: Generator copies of Uniform Hazardous Waste Manifest (UHWM)number 024410606JJK(8/21/2023) was not sent to the California Department of Toxic Substances Control (DTSC)within 30 days of hazardous waste shipment. The manifest was not found in the DTSC Hazardous Waste Tracking System or on RCRAInfo. The facility could not demonstrate during the inspection that this manifest was properly handled (mailed to DTSC). REGULATION GUIDANCE: Hazardous waste generators are required to send a copy of the generator signed UHWM to DTSC by mail. The only exception is when an UHWM starts and finishes as an electronic manifest in the e-Manifest System. The generator shall within 30 days of each shipment of hazardous waste submit to DTSC a legible copy of each manifest used.The mailing address is: DTSC Generator Manifests, Department of Toxic Substances Control, P.O. Box 400, Sacramento, CA 95812-0400. CORRECTIVE ACTION: Immediately mail a copy of the listed UHWMs and ensure that copies of all generator signed UHWMs are sent to DTSC within 30 days of shipping the hazardous waste. Also provide a corrective action statement and supporting documentation to the San Joaquin County Environmental Health Department(EHD). This is(Minor)Violation. 14 CA Code of Regulations 66262.11 3130001 -Determined if waste generated is hazardous waste. OBSERVATIONS:A hazardous waste determination has not been made for the following in the hazardous materials storage area: -Liquid in the secondary containment -White poly container with handwritten"UN1593, RQ Dichloromethane 6.1, PG 111 Net:20L"label and"Toxic"label. The facility could not provide information to verify that the chemical is still in use. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. Title 22 CCR section 66261.2—Definition of Waste Title 22 CCR section 66261.3—Definition of Hazardous Waste A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the date that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include Safety Data Sheets (SIDS), waste test results or other hazardous waste determination documentation. CORRECTIVE ACTION: Immediately make a hazardous waste determination for each waste and manage it according to Title 22 CCR. Use Safety Data Sheets(SIDS),waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination.
