Send a copy to the San Joaquin County Environmental Health Department <br /> (EHD). <br /> This is a repeat violation (Class 2) Violation. <br /> 10 CA Code of Regulations 66262.23(a)(4) 3110006-Sent a legible copy of each Uniform Hazardous Waste Manifest to <br /> the DTSC within 30 days of shipment. <br /> OBSERVATION: Generator copies of Uniform Hazardous Waste Manifest (UHWM)number 024410606JJK(8/21/2023) <br /> was not sent to the California Department of Toxic Substances Control (DTSC)within 30 days of hazardous waste <br /> shipment. The manifest was not found in the DTSC Hazardous Waste Tracking System or on RCRAInfo. The facility <br /> could not demonstrate during the inspection that this manifest was properly handled (mailed to DTSC). <br /> REGULATION GUIDANCE: Hazardous waste generators are required to send a copy of the generator signed UHWM <br /> to DTSC by mail. The only exception is when an UHWM starts and finishes as an electronic manifest in the <br /> e-Manifest System. The generator shall within 30 days of each shipment of hazardous waste submit to DTSC a <br /> legible copy of each manifest used.The mailing address is: DTSC Generator Manifests, Department of Toxic <br /> Substances Control, P.O. Box 400, Sacramento, CA 95812-0400. <br /> CORRECTIVE ACTION: Immediately mail a copy of the listed UHWMs and ensure that copies of all generator signed <br /> UHWMs are sent to DTSC within 30 days of shipping the hazardous waste. Also provide a corrective action <br /> statement and supporting documentation to the San Joaquin County Environmental Health Department(EHD). <br /> This is(Minor)Violation. <br /> 14 CA Code of Regulations 66262.11 3130001 -Determined if waste generated is hazardous waste. <br /> OBSERVATIONS:A hazardous waste determination has not been made for the following in the hazardous materials <br /> storage area: <br /> -Liquid in the secondary containment <br /> -White poly container with handwritten"UN1593, RQ Dichloromethane 6.1, PG 111 Net:20L"label and"Toxic"label. <br /> The facility could not provide information to verify that the chemical is still in use. <br /> REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as <br /> specified in Title 22 California Code of Regulations(CCR). There are wastes that are listed as hazardous wastes. <br /> There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or <br /> ignitable. Title 22 CCR section 66261.2—Definition of Waste Title 22 CCR section 66261.3—Definition of Hazardous <br /> Waste A business operator shall keep records of any hazardous waste determinations made in accordance with Title <br /> 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the date that the waste was <br /> last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include Safety Data Sheets <br /> (SIDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Immediately make a hazardous waste determination for each waste and manage it according <br /> to Title 22 CCR. Use Safety Data Sheets(SIDS),waste sampling and test results or other knowledge to support your <br /> hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including <br /> sections 66261.20-24.
