Provide disposal records for <br /> wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for <br /> your hazardous waste generator status. <br /> This is a repeat violation (Class 2) Violation. <br /> 15 CA Code of Regulations 66262.40(c)3130028-Kept records of any test results,waste analyses, or other <br /> determinations. <br /> OBSERVATION: The wood sanding dust waste is being disposed of as non-hazardous waste.The business stated a <br /> hazardous waste determination had been made but could not provide the hazardous waste determination records <br /> during the inspection. <br /> REGULATION GUIDANCE:A business operator shall keep records of any hazardous waste determinations made in <br /> accordance with Title 22 California Code of Regulations(CCR)section 66262.11 for at least three years from the date <br /> that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include <br /> Safety Data Sheets(SDS), waste test results or other hazardous waste determination documentation. <br /> CORRECTIVE ACTION: Assemble the hazardous waste determination documentation for the wood sanding dust <br /> waste, maintain on site and submit a copy to the San Joaquin County Environmental Health Department(EHD). If <br /> hazardous waste determination documentation is not available, immediately make a hazardous waste determination <br /> and begin managing the wood sanding dust waste as specified in Title 22 CCR. Use Safety Data Sheets(SDS), <br /> waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing <br /> must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and <br /> supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for <br /> wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes <br /> and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status. <br /> This is a repeat violation(Class 2) Violation. <br /> 65 CA Code of Regulations 66265.33 3130015-Tests and maintains all required safety equipment at the facility. <br /> OBSERVATION: Standing liquid was observed within the secondary containment of the hazardous waste storage area. <br /> A fire extinguisher was observed not charged in the hazardous waste storage area. <br /> REGULATION GUIDANCE:All facility communications or alarm systems, fire protection equipment, spill control <br /> equipment, and decontamination equipment,where required,shall be tested and maintained as necessary to assure <br /> its proper operation in time of emergency. <br /> CORRECTIVE ACTION: Bring all safety equipment into proper working order by removing the liquid in the secondary <br /> containment and placing in the proper waste container and ensuring all fire extinguishers are charged. Provide a <br /> corrective action statement to the San Joaquin County Environmental Health Department within 30 days. <br /> This is a repeat violation(Class 2) Violation. <br /> Overall Inspection Comments: <br /> A walk-through of the facility was completed on 2/18/25 and a paperwork inspection was completed on 3/11/2025. <br /> An inspection checklist was provided to the facility on 4/212025.
