OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan reviewed at the time of inspection, dated 3/27/2024, did not follow the order or requirements of 40 CFR Part 112.7. - In the section, "Discharge Prevention Measures", it states that to review monthly inspection reports for the AST and portable containers to refer to "Attachment 2". Attachment 2 was reviewed and titled as "Discharge Prevention Measures". Therefore, the plan does not include adequate cross-reference. REGULATION GUIDANCE: The plan must include adequate cross reference CORRECTIVE ACTION: Ensure that your SPCC Plan complies with the following requirements: It follows the required SPCC rule sequence and/or includes adequate cross-reference. Provide proof of correction to the EHD. This is (Minor) Violation. 11 Code of Fed Regulations 112.7(a)(3vi), 112.7(a4) 4010017 - SPCC contains procedures for reporting a discharge. OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan does not adequately discuss procedures for reporting a discharge. - The plan does not include names of individuals/organizations contacted in the event of a discharge. REGULATION GUIDANCE: Unless you have submitted a response plan under § 112.20, provide information and procedures in your Plan to enable a person reporting a discharge as described in § 112.1(b) to relate information on the exact address or location and phone number of the facility; the date and time of the discharge, the type of material discharged; estimates of the total quantity discharged; estimates of the quantity discharged as described in § 112.1(b); the source of the discharge; a description of all affected media ; the cause of the discharge; any damages or injuries caused by the discharge; actions being used to stop, remove, and mitigate the effects of the discharge ; whether an evacuation may be needed; and, the names of individuals and/or organizations who have also been contacted. CORRECTIVE ACTION: Immediately amend the SPCC Plan to include names of individuals/organizations contacted in the event of a discharge. Submit proof of correction to the EHD. This is (Minor) Violation. 20 Code of Fed Regulations 112.7(b) 4010019 - SPCC predicts direction, rate of flow, total quantity of oil that could be released from a discharge. OBSERVATION: The Spill Prevention, Control, and Countermeasure (SPCC) Plan failed to predict the direction, rate of flow, and the total quantity of the oil that could be discharged for each type of major equipment failure.
