Environmental Health Department <br />CP22 - AST Non-Qualified Inspection Report <br />Date: <br />March 20, 2025 <br /> Facility Address: <br /> 4469 S ESCALON BELLOTA RD, FARMINGTON <br /> Facility Name: <br /> FARMINGTON CIRCLE K <br />SUMMARY OF VIOLATIONS <br />(CLASS I, CLASS II, or MINOR - Notice to Comply) <br />RemarksItem # <br />- The section "Potential Equipment Failure & Secondary Containment", only mentions that the tanks have secondary <br />containment in the form of double wall tanks with a capacity of 44,000 gallons. There is no mention of direction or rate <br />of flow in the event of equipment failure. The possibility of tank overfill is addressed under the subsection, "Product <br />Transfer Area" but it does not mention direction or rate of flow in the event of equipment failure. <br />REGULATION GUIDANCE: (b) Where experience indicates a reasonable potential for equipment failure (such as <br />loading or unloading equipment, tank overflow, rupture, or leakage, or any other equipment known to be a source of a <br />discharge), include in your Plan a prediction of the direction, rate of flow, and total quantity of oil which could be <br />discharged from the facility as a result of each type of major equipment failure. <br />CORRECTIVE ACTION: Ensure the SPCC plan addresses the the direction, rate of flow, and the total quantity of the <br />oil that could be discharged for each type of major equipment failure. Submit proof of correction to the EHD. <br />This is a repeat violation (Class 2) Violation. <br />Code of Fed Regulations 112.7(f)(1), 112.7(f)(3) 4010023 - Employee training and spill prevention briefings discussed in <br />SPCC plan. <br />OBSERVATION: Failure to include in the Spill Prevention, Control, and Countermeasure (SPCC) Plan a discussion, or <br />adequate description of all required employee training including annual spill prevention briefings provided to oil-handling <br />personnel. <br />- The section "Personnel, Training For Discharge Prevention Procedures ", does not indicate that briefings are to be <br />done annually. Instead this section states that the briefings will be held "frequent enough to maintain knowledge and <br />skills adequate to execute the provisions of this SPCC Plan". <br />REGULATION GUIDANCE: (f)(1) At a minimum, train your oil-handling personnel in the operation and maintenance of <br />equipment to prevent discharges; discharge procedure protocols; applicable pollution control laws, rules, and <br />regulations; general facility operations; and, the contents of the facility SPCC Plan. (f)(3) Schedule and conduct <br />discharge prevention briefings for your oil-handling personnel AT LEAST ONCE A YEAR to ensure an adequate <br />understanding of the SPCC Plan for that facility. Such briefings must highlight and describe known discharges as <br />described in § 112.1(b) or failures, malfunctioning components, and any recently developed precautionary measures. <br />CORRECTIVE ACTION: The SPCC Plan shall include an adequate description of employee training that is conducted <br />at least once a year. Training shall address , at a minimum: operation and maintenance of equipment to prevent <br />discharges; discharge procedure protocols; applicable pollution control laws, rules, and regulations; general facility <br />operations; content of the facility SPCC plan; and annual discharge prevention briefings for oil-handling personnel to <br />assure adequate understanding of the SPCC plan. Provide proof of correction to the EHD. <br />This is a repeat violation (Class 2) Violation. <br /> 29 <br />Code of Fed Regulations 112.7(e), 112.8(c)(6) 4010021 - Written Inspection/testing procedures kept, inspection/testing <br />records signed, kept for 3 years. <br />OBSERVATION: The facility failed to keep written procedures and records of inspections and tests, including integrity <br />tests, for at least three years. <br />- Copies of testing records for buried piping that occurred on March 4, 2023 were not found on site.
