Section 3.0 & Section 3.5.3 of the SPCC plan indicates that there are spill kits located near the tank farm and within the tire shop, at the time of inspection Manager Shey McBride said there is only one spill kit and it was located near the dumpsters in a locked shed. Section 3.7.3 of the SPCC Plan states that annual inspections are performed and that the records remain with the SPCC plan for a period of at least 3 years. At time of inspection, these records were not available. Section 3.7.5 of the SPCC Plan states that annual discharge prevention briefings are held and that records of the briefings and discharge prevention training are kept with the plan for a period of 3 years. At the time of inspection, facility was only able to provide records for 2023 and 2024, not 3 years. REGULATION GUIDANCE: 112.3: The owner or operator or an onshore or offshore facility subject to this section must prepare in writing and implement a Spill Prevention Control and Countermeasure Plan. CORRECTIVE ACTION: Implement the SPCC plan, as required by ensuring that there is a spill kit located near the tank farm and within the truck repair shop. Also, ensure the annual inspections are performed and remain with the SPCC plan for a period of 3 years. Lastly, ensure that the discharge prevention briefings are conducted annually and kept with the SPCC plan for a period of 3 years. Submit proof of correction to the EHD.
