SAN J0AQUIN <br />COUNTY <br />AMENDED Environmental Health Department <br />7/7/2025 <br />Aboveground Petroleum Storage Act Program Inspection Report <br />Facility Name: <br />Facility Address: <br />1525 <br />Date: <br />DAMERON HOSPITAL <br />W ACACIA ST STOCKTON <br />June 19 2025 <br />5 <br />Code of Fed Regulations 112.3(d) 4010003 - Professional engineer has properly reviewed and certified the SPCC Plan <br />OBSERVATION: At the time of inspection, the facility's SPCC plan lacked a Professional Engineer certification. <br />REGULATION GUIDANCE: (d) Except as provided in § 112.6, a licensed Professional Engineer must review and certify <br />a Plan for it to be effective to satisfy the requirements of this part. (1) By means of this certification, the Professional <br />Engineer attests: (i) That he is familiar with the requirements of § 112.3; (ii) That he or his agent has visited and <br />examined the facility; (iii) That the Plan has been prepared in accordance with good engineering practice, including <br />consideration of applicable industry standards, and with the requirements of this part; (iv) That procedures for required <br />inspections and testing have been established; and (v) That the Plan is adequate for the facility. (vi) That, if applicable, <br />for a produced water container subject to § 112.9(c)(6), any procedure to minimize the amount of free -phase oil is <br />designed to reduce the accumulation of free -phase oil and the procedures and frequency for required inspections, <br />maintenance and testing have been established and are described in the Plan. <br />CORRECTIVE ACTION: This was corrected on site. <br />This is a (Class 2) Violation. <br />10 <br />Code of Fed Regulations 112.5(b) 4010009 - 5 year review performed on SPCC and documented <br />OBSERVATION: The facility failed to perform the 5 -year review of the Spill Prevention, Control, and Countermeasure <br />(SPCC) Plan. The facility's SPCC Plan was last reviewed on June 12, 2020. <br />REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a) of this section, complete a review <br />and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to this part; <br />or, if your facility was in operation on or before August 16, 2002, five years from the date your last review was required <br />under this part. As a result of this review and evaluation, you must amend your SPCC Plan within six months of the <br />review to include more effective prevention and control technology if the technology has been field -proven at the time of <br />the review and will significantly reduce the likelihood of a discharge as described in § 112.1(b) from the facility. You must <br />implement any amendment as soon as possible, but not later than six months following preparation of any amendment. <br />You must document your completion of the review and evaluation, and must sign a statement as to whether you will <br />amend the Plan, either at the beginning or end of the Plan or in a log or an appendix to the Plan. The following words will <br />suffice, "I have completed review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) <br />amend the Plan as a result." <br />CORRECTIVE ACTION: Immediately complete and document the 5 -year review of the SPCC Plan and make any <br />necessary amendments (a Professional Engineer must certify any technical amendments). Submit verification of <br />adequate SPCC plan review completion to the EHD. <br />This is a (Minor) Violation. <br />11 <br />Code of Fed Regulations 112.7 4010012 - SPCC in writing, follows code seq/cross ref, good eng practice, mgt <br />approval, items not in place <br />OBSERVATION: The full approval of management at a level of authority to commit the necessary resources to fully <br />implement the Plan section in the SPCC plan was not signed. The listed manager has not been with the facility for <br />longer than 6 months. <br />REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in <br />accordance with good engineering practices. The Plan must have the full approval of management at a level of authority <br />to commit the necessary resources to fully implement the Plan. <br />CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility.
