SAN J0AQUIN COUNTY AMENDED Environmental Health Department 7/7/2025 Aboveground Petroleum Storage Act Program Inspection Report Facility Name: Facility Address: 1525 Date: DAMERON HOSPITAL W ACACIA ST STOCKTON June 19 2025 5 Code of Fed Regulations 112.3(d) 4010003 - Professional engineer has properly reviewed and certified the SPCC Plan OBSERVATION: At the time of inspection, the facility's SPCC plan lacked a Professional Engineer certification. REGULATION GUIDANCE: (d) Except as provided in § 112.6, a licensed Professional Engineer must review and certify a Plan for it to be effective to satisfy the requirements of this part. (1) By means of this certification, the Professional Engineer attests: (i) That he is familiar with the requirements of § 112.3; (ii) That he or his agent has visited and examined the facility; (iii) That the Plan has been prepared in accordance with good engineering practice, including consideration of applicable industry standards, and with the requirements of this part; (iv) That procedures for required inspections and testing have been established; and (v) That the Plan is adequate for the facility. (vi) That, if applicable, for a produced water container subject to § 112.9(c)(6), any procedure to minimize the amount of free -phase oil is designed to reduce the accumulation of free -phase oil and the procedures and frequency for required inspections, maintenance and testing have been established and are described in the Plan. CORRECTIVE ACTION: This was corrected on site. This is a (Class 2) Violation. 10 Code of Fed Regulations 112.5(b) 4010009 - 5 year review performed on SPCC and documented OBSERVATION: The facility failed to perform the 5 -year review of the Spill Prevention, Control, and Countermeasure (SPCC) Plan. The facility's SPCC Plan was last reviewed on June 12, 2020. REGULATION GUIDANCE: (b) Notwithstanding compliance with paragraph [112.5] (a) of this section, complete a review and evaluation of the SPCC Plan at least once every five years from the date your facility becomes subject to this part; or, if your facility was in operation on or before August 16, 2002, five years from the date your last review was required under this part. As a result of this review and evaluation, you must amend your SPCC Plan within six months of the review to include more effective prevention and control technology if the technology has been field -proven at the time of the review and will significantly reduce the likelihood of a discharge as described in § 112.1(b) from the facility. You must implement any amendment as soon as possible, but not later than six months following preparation of any amendment. You must document your completion of the review and evaluation, and must sign a statement as to whether you will amend the Plan, either at the beginning or end of the Plan or in a log or an appendix to the Plan. The following words will suffice, "I have completed review and evaluation of the SPCC Plan for (name of facility) on (date), and will (will not) amend the Plan as a result." CORRECTIVE ACTION: Immediately complete and document the 5 -year review of the SPCC Plan and make any necessary amendments (a Professional Engineer must certify any technical amendments). Submit verification of adequate SPCC plan review completion to the EHD. This is a (Minor) Violation. 11 Code of Fed Regulations 112.7 4010012 - SPCC in writing, follows code seq/cross ref, good eng practice, mgt approval, items not in place OBSERVATION: The full approval of management at a level of authority to commit the necessary resources to fully implement the Plan section in the SPCC plan was not signed. The listed manager has not been with the facility for longer than 6 months. REGULATION GUIDANCE: If you are the owner or operator of a facility subject to this part you must prepare a Plan in accordance with good engineering practices. The Plan must have the full approval of management at a level of authority to commit the necessary resources to fully implement the Plan. CORRECTIVE ACTION: Immediately obtain required management approval for the SPCC Plan for this facility. Provide proof of correction to the EHD. This is a (Minor) Violation.
