SAN J0AQUIN <br />COUNTY <br />AMENDED Environmental Health Department <br />7/7/2025 <br />Aboveground Petroleum Storage Act Program Inspection Report <br />Facility Name: <br />Facility Address: <br />Date: <br />DAMERON HOSPITAL <br />1525 W ACACIA ST STOCKTON <br />June 19 2025 <br />57 <br />Code of Fed Regulations 112.7(e), 112.8(c)(6) 4010021 - Written Inspection/testing procedures kept, inspection/testing <br />records signed, kept for 3 years <br />OBSERVATION: The facility failed to comply with the following requirements: <br />1. Keep written procedures and records of inspections and integrity tests for at least three years. The facility failed to <br />maintain records of inspections and tests in accordance with written procedures that the certifying engineer developed for <br />the facility, including integrity tests, signed by the appropriate supervisor or inspector. The inspection forms used onsite <br />are not the forms included in the Spill Prevention, Control, and Countermeasure (SPCC) Plan, [and in some instances, <br />these forms do not contain the information required by the SPCC plan]. <br />2. Keep comparison records for bulk storage containers subject to 40 CFR 112.8(c)(6). <br />The facility's "Daily Bulk Diesel Aboveground Tank Inspection Checklist" logs, as discussed in the SPCC Plan, were <br />missing at the time of inspection. <br />REGULATION GUIDANCE: 112.7(e) Conduct inspections and tests required by this part in accordance with written <br />procedures that you or the certifying engineer develop for the facility. <br />CORRECTIVE ACTION: Immediately begin conducting all inspections and tests in accordance with the procedures <br />outlined in the SPCC Plan and begin using forms provided by the SPCC plan. Keep written inspection procedures and <br />records of inspections and testing signed by the appropriate supervisor/inspector for at least three years. Submit proof of <br />correction to the EHD. <br />This is a (Class 2) Violation. <br />74 <br />CA Health and Safety Code 25270.6(a) 4010032 - Tank Facility Statement or Business Plan has been submitted <br />OBSERVATION: A complete Aboveground Petroleum Storage Act (APSA) tank facility statement or a hazardous <br />materials business plan has not been submitted to the California Environmental Reporting System (CERS) annually <br />since 4/4/2019. <br />REGULATION GUIDANCE: (a)(1) On or before January 1, annually, each owner or operator of a tank facility subject to <br />this chapter shall file with the statewide information management system, a tank facility statement that shall identify the <br />name and address of the tank facility, a contact person for the tank facility, the total storage capacity of the tank facility, <br />and the location and contents of each petroleum storage tank that exceeds 10,000 gallons in storage capacity. A copy of <br />a statement submitted previously pursuant to this section may be submitted in lieu of a new tank facility statement if no <br />new or used storage tanks have been added to the facility or if no significant modifications have been made. For <br />purposes of this section, a significant modification includes, but is not limited to, altering existing storage tanks or <br />changing spill prevention or containment methods. (2) Notwithstanding paragraph (1), an owner or operator of a tank <br />facility that submits a business plan, as defined in subdivision (d) of Section 25501 , to the statewide information <br />management system and that complies with Sections 25503 , 25505 , 25505.1 , 25507 , 25507.2 , 25508 , 25508.1 , and <br />25508.2 , satisfies the requirement in paragraph (1) to file a tank facility statement. <br />CORRECTIVE ACTION: This was corrected on site. <br />This is a (Class 2) Violation. <br />EHD - CUPA Inspection Report IS02 <br />Page 8 of 10 FA0002864 PR0526379 4518491 7/7/2025 <br />1868 E.
