SAN J0AQUIN <br />COUNTY <br />AMENDED Environmental Health Department <br />7/7/2025 <br />Aboveground Petroleum Storage Act Program Inspection Report <br />Facility Name: <br />Facility Address: <br />1525 <br />Date: <br />DAMERON HOSPITAL <br />W ACACIA ST STOCKTON <br />June 19 2025 <br />77 <br />Code of Fed Regulations 112.1(b)(3), 112.2 4030036 - All/any permanently closed tanks are properly closed under the <br />definition in 40 CFR 112.2 <br />OBSERVATION: The facility SPCC plan notes the 275 -gallon, 100 -gallon, and 50 -gallon day use tanks are not in use. At <br />the time of inspection, the tanks did not meet the following conditions for permanent closure: <br />- remove all liquid and sludge from each container and connecting line <br />- disconnect and blank off all connecting lines and piping have from the tank/ container - close and lock all valves <br />- post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. <br />REGULATION GUIDANCE: When a tank is not in use, it must be permanently closed by meeting the following <br />conditions: <br />- remove all liquid and sludge from each container and connecting line <br />- disconnect and blank off all connecting lines and piping have from the tank/ container - close and lock all valves <br />- post a sign conspicuously stating that it is a permanently closed container and denoting the date of closure. <br />CORRECTIVE ACTION: Tanks that are not being used or are not addressed in the Spill Prevention, Control, and <br />Countermeasure (SPCC) Plan must either be included in your plan or meet the permanent closure requirements noted <br />above. Provide verification to the EHD of proper closure of the tanks. <br />This is a (Minor) Violation. <br />78 <br />Code of Fed Regulations 112.20(e) 4010044 - Substantial Harm Criteria certification maintained at the facility as <br />required <br />OBSERVATION: The facility failed to complete and maintain (at the facility) the Substantial Harm Criteria certification <br />form, and the owner/or operator determined that the facility could not be reasonably expected to cause substantial harm <br />to the environment. The facility's Substantial Harm Criteria certification form was missing the signature from the owner/or <br />operator. <br />REGULATION GUIDANCE: (e) If the owner or operator of a facility determines pursuant to paragraph (a)(2) of this <br />section that the facility could not, because of its location, reasonably be expected to cause substantial harm to the <br />environment by discharging oil into or on the navigable waters or adjoining shorelines, the owner or operator shall <br />complete and maintain at the facility the certification form contained in appendix C to this part and, in the event an <br />alternative formula that is comparable to one contained in appendix C to this part is used to evaluate the criterion in <br />paragraph (f)(1)(ii)(B) or (f)(1)(ii)(C) of this section, the owner or operator shall attach documentation to the certification <br />form that demonstrates the reliability and analytical soundness of the comparable formula and shall notify the Regional <br />Administrator in writing that an alternative formula was used. <br />CORRECTIVE ACTION: This was corrected on site. <br />This is a (Minor) Violation. <br />79 <br />CA Health and Safety Code 25404(e)(4) 4010 - Administration/Documentation - General <br />OBSERVATION: The facility failed to annually submit a complete and accurate APSA Facility Information Form to the <br />California Environmental Reporting System (CERS): <br />- The facility failed to submit the most recent date of the SPCC Plan Certification or date of the 5 -year SPCC Plan review. <br />inventory business plan. These information was last submitted the form on 4/4/2019. <br />-The facility failed to include the combined capacity of the two 150 -gallon diesel day tanks to the tank facility statement <br />"Total Aboveground Storage Capacity of Petroleum" section and to the hazardous materials <br />REGULATION: (a) The Owner or Operator of a tank facility shall submit the following <br />information ("APSA Facility Information") to the California Environmental Reporting System (CERS), within 12 months of <br />December 17, 2024, and annually thereafter: <br />1. Conditionally exempt from SPCC Plan status; <br />2. Date of SPCC Plan certification or 5 -year review, whichever is more recent; <br />3. Total aggregate petroleum storage capacity of tank facility in gallons; and <br />4.
