PATRIOT <br /> ENVIRONMENTAL ON SITE AND CONTAINING THE RELEASE. NO WATERWAYS IMPACTED OR INJURIES <br /> REPORTED. <br /> OBSERVATIONS: <br /> The following information was obtained from Mike Algots of UPRR and Joe McGuffin of Patriot Environmental: <br /> -The release has been stopped.Approximately 2-3 gallons of diesel released onto pavement and the sides of a locomotive <br /> due to a locomotive mechanical issue. No waterways, soil, or ballasts were impacted. <br /> -Patriot Environmental to perform spill clean-up,which includes pumping diesel from a spill sump located on the locomotive. <br /> -The clean-up material, including the diesel from the sump,will be kept on site at UPRR until a sample analytical is obtained <br /> by Patriot Environmental to make a waste determination for disposal. <br /> UPRR is to provide the EHD with the following: <br /> -Amount of waste generated from this spill clean-up <br /> -A copy of the sample analytical results prior to disposal of the waste <br /> -Waste disposal records for all clean up debris associated with this spill clean up <br /> Please be advised that the disposal of any waste[HSC 5411]or disposal of any hazardouswaste, or the causing thereof, is <br /> prohibited when the disposal is at a facility which is not permitted or authorized for hazardous waste disposal.[HSC 25189.5 <br /> (a).]. Please be aware that all hazardous waste shall be disposed of under appropriate hazardous waste manifesting <br /> procedure[HSC 25160(b)(3)]. Provide a waste/hazardous waste disposal records to the EHD for all clean up debris <br /> associated with this spill clean up. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> 11 Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> • Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Immediately <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
