Patriot Environmental Services was onsite for cleanup. Michael Algots, Union Pacific Hazmat field <br /> manager reported that the load consisted of 55-gallon drums containing metalworking lubricant.The 55-gallon drums were <br /> ofFloaed to reveal that one 55-gallon drum was damaged and released approximately 5 gallons of metalworking lubricant. <br /> Patriot performed cleanup using absorbents. The damaged 55-gallon drum was overpacked. One 55-gallon drum of waste <br /> was generated from cleanup. Per Derek Smith of Patriot Environmental Services,the waste will be managed as non-RCRA <br /> hazardous waste. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> ° Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> • Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> ° Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> ORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> Submit copy of disposal record for the non-RCRA hazardous waste 55-gallon drum to EHD. <br /> Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
