No waterways affected. <br /> OBSERVATIONS: <br /> Arrived on site and met with Derek Smith of Patriot Environmental. Approximately 5 gallons of battery acid was released <br /> when a wet acid battery tipped over due to improper blocking and bracing. The initial spill site in lot 7 covered an <br /> approximate area of 10x10 feet with four additional wheel marks. Trailer was taken to the leaker area of the yard and <br /> resulted in a spill covering an approximate area of 5x5 feet. Acid was neutralized with sodium bicarbonate. Patriot <br /> Environmental is currently waiting for a forklift to start unloading the trailer to get to the spill area. Waste generated will be <br /> handled as hazardous waste and remain on site until disposal per Derek Smith. No waterways or storm drains were <br /> impacted. Spill did not go off the property. YRC to notify SJC EHD when clean-up is complete. YRC to provide SJC EHD <br /> with final disposal records and any analytical/waste profile for the waste generated. <br /> VIOLATIONS: <br /> • Discharge of any waste, including sewage <br /> (CA Health and Safety Code 5411) <br /> Discharge of waste or sewage to water or within 150 ft. of waterway <br /> (SJC Ordinance Code Sections 9-1125.3, 9-1125.4) <br /> ° Improper disposal of a hazardous waste <br /> (CA Health and Safety Code 25189.5) <br /> 11 Permitting or Maintaining a Nuisance <br /> (SJC Ordinance Code Section 8-5100) <br /> ° Other Violation <br /> CORRECTIVE ACTIONS/ORDER: <br /> • Investigate and abate contamination under the oversite of the appropriate lead agency. <br /> • Submit copies of hazardous waste manifests/disposal records to the EHD. <br /> 11 Other Correction <br /> EHD 25-01 Rev.08/17/17 Page 1 of 2 WASTE DISCHARGE/SPILL RESPONSE NOTICE TO ABATE <br /> 1868 E.
