CORRECTIVE ACTION: Submit a copy of all consolidated manifests for the past three years from 4/11/2022-4/11/2025 to the EHD for review. Maintain the records on-site for three years from the date of shipping and provide a copy to the San Joaquin County Environmental Health Department (EHD). If the receipts cannot be found, provide a statement to the EHD that future receipts will be maintained on-site for three years. This is (Class 2) Violation. CA Code of Regulations 66262.11 3030005 - Determined if waste generated is hazardous waste. OBSERVATIONS: A fire occurred at this facility on 4/2/2025. Fire debris was observed around the facility. Several black 55 gallon drums containing carbon powder, and several blue 55 gallon drums labeled "Non-Regulated Waste Anode Scrap Foil" had been damaged in the fire. Black powder was observed on the floor from the drums and the burnt debris. REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous wastes. There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or ignitable. Title 22 CCR section 66261.2 – Definition of Waste Title 22 CCR section 66261.3 – Definition of Hazardous Waste A business operator shall keep records of any hazardous waste determinations made in accordance with Title 22 California Code of Regulations (CCR) section 66262.11 for at least three years from the date that the waste was last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include Safety Data Sheets (SDS), waste test results or other hazardous waste determination documentation. CORRECTIVE ACTION: Immediately make hazardous waste determinations for the wastes noted above and for all fire debris and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results or other knowledge to support your hazardous waste determination. Waste testing must be done using methods specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than the number of days specified in Title 22 CCR for your hazardous waste generator status. This is (Class 2) Violation. 11 CA Code of Regulations 66262.40(c) 3030053 - Kept records of any test results, waste analyses, or other determinations. OBSERVATION: Approximately three hundred 55 gallon drums were observed during the inspection. Per Admin Lulu Reyes, the material in the black drums were "carbon". The material in the blue drums were labeled "Non-Regulated Waste Anode Scrap Foil ." Several blue drums were also labeled as "Anode Scrap Powder." One black 55 gallon steel drum in the storage area was labeled as "Recycling Hazwaste." Owner Randy Ly stated that the drums are all the same material and are received from Tesla .
