Maintain the records on-site for three years from the date of shipping and <br />provide a copy to the San Joaquin County Environmental Health Department (EHD). If the receipts cannot be found, <br />provide a statement to the EHD that future receipts will be maintained on-site for three years. <br />This is (Class 2) Violation. <br />CA Code of Regulations 66262.11 3030005 - Determined if waste generated is hazardous waste. <br />OBSERVATIONS: A fire occurred at this facility on 4/2/2025. Fire debris was observed around the facility. Several <br />black 55 gallon drums containing carbon powder, and several blue 55 gallon drums labeled "Non-Regulated Waste <br />Anode Scrap Foil" had been damaged in the fire. Black powder was observed on the floor from the drums and the <br />burnt debris. <br />REGULATION GUIDANCE: Any person who generates a waste shall determine if the waste is a hazardous waste as <br />specified in Title 22 California Code of Regulations (CCR). There are wastes that are listed as hazardous wastes. <br />There are wastes that exhibit one or more of the hazardous waste characteristics: toxic, corrosive, reactive or <br />ignitable. Title 22 CCR section 66261.2 – Definition of Waste Title 22 CCR section 66261.3 – Definition of Hazardous <br />Waste A business operator shall keep records of any hazardous waste determinations made in accordance with Title <br />22 California Code of Regulations (CCR) section 66262.11 for at least three years from the date that the waste was <br />last sent to an on-site or off-site treatment, storage, or disposal facility. The records may include Safety Data Sheets <br />(SDS), waste test results or other hazardous waste determination documentation. <br />CORRECTIVE ACTION: Immediately make hazardous waste determinations for the wastes noted above and for all <br />fire debris and manage it according to Title 22 CCR. Use Safety Data Sheets (SDS), waste sampling and test results <br />or other knowledge to support your hazardous waste determination. Waste testing must be done using methods <br />specified in Title 22 CCR including sections 66261.20-24. Submit a statement and supporting documentation with <br />your hazardous waste determination. Demonstrate current storage and labeling for wastes determined to be <br />hazardous wastes. Provide disposal records for wastes determined to be hazardous wastes and stored longer than <br />the number of days specified in Title 22 CCR for your hazardous waste generator status. <br />This is (Class 2) Violation. <br /> 11 <br />CA Code of Regulations 66262.40(c) 3030053 - Kept records of any test results, waste analyses, or other <br />determinations. <br />OBSERVATION: Approximately three hundred 55 gallon drums were observed during the inspection. Per Admin Lulu <br />Reyes, the material in the black drums were "carbon". <br />The material in the blue drums were labeled "Non-Regulated Waste Anode Scrap Foil ." Several blue drums were also <br />labeled as "Anode Scrap Powder." <br />One black 55 gallon steel drum in the storage area was labeled as "Recycling Hazwaste." <br />Owner Randy Ly stated that the drums are all the same material and are received from Tesla .
