FINDINGS FOR CONDITIONAL USE PERMIT <br /> PA-2600014 <br /> JORDAN JONES I CALSOLAR <br /> 1. The proposed use is consistent with the goals, policies, standards, and maps of the General Plan, any <br /> applicable Master Plan, Specific Plan, and Special Purpose Plan, and any other applicable plan <br /> adopted by the County. <br /> • This finding can be made because the proposed 4,043.52-kilowatt (kW) ground-mounted <br /> photovoltaic solar energy system is located on a property with a General Plan designation <br /> of AIG (Agriculture) and a zoning designation of AG-40. Utility-scale solar energy facilities <br /> are conditionally permitted within the AG zoning district subject to approval of a Conditional <br /> Use Permit. The project is subject to San Joaquin County solar energy development <br /> standards, including applicable siting and setback requirements. Although the project <br /> exceeds the maximum size for solar facilities on agricultural properties (Development Title <br /> Section 9-409.430 (B)(5)),the Planning Commission can make the finding that the proposed <br /> facility will not adversely affect agricultural production. This finding can be made because <br /> the soil will be protected for future agricultural use upon decommissioning of the facility <br /> and the remainder of the site will remain available for current agricultural operations. The <br /> proposed use is consistent with the goals and policies of the General Plan related to <br /> renewable energy development and continued agricultural land stewardship, and there are <br /> no applicable Master Plans, Specific Plans, or Special Purpose Plans governing the project <br /> site. Therefore, the proposed use is consistent with the General Plan and all applicable <br /> County-adopted plans. <br /> 2. Adequate utilities, roadway improvements, sanitation, water supply, drainage, and other necessary <br /> facilities have been provided, and the proposed improvements are properly related to existing and <br /> proposed roadways. <br /> • This finding can be made because the project site is an existing agricultural parcel that is <br /> served by adequate utilities and public facilities. Access to the site is provided via an <br /> existing driveway connection to East Lone Tree Road,a County-maintained roadway,which <br /> is adequate to serve the proposed use. The site is served by existing on-site private well <br /> water, septic, and stormwater drainage systems, all of which will remain in place and are <br /> sufficient to support the proposed project. No expansion of utility systems, roadway <br /> improvements, or new infrastructure connections are proposed as part of this application. <br /> Therefore, adequate utilities, roadway access,sanitation,water supply,drainage, and other <br /> necessary facilities are available to serve the proposed use. <br /> 3. The site is physically suitable for the type of development and for the intensity of development. <br /> • This finding can be made because the approximately 39.65-acre parcel is physically suitable <br /> for the proposed utility-scale solar energy facility, which will occupy approximately 14.47 <br /> acres of the site. The project is sited on an existing agricultural parcel within the AG-40 <br /> zoning district and is of sufficient size and configuration to accommodate the proposed <br /> solar array while maintaining setbacks required under the Development Title, including the <br /> 30-foot setback requirement for ground-mounted systems in agricultural zones. The site is <br /> currently under a Williamson Act Land Conservation Contract; however, renewable energy <br /> uses are conditionally permitted subject to compliance with applicable standards and <br /> approval of a Conditional Use Permit.The project does not include building construction or <br /> expansion and utilizes existing site access and infrastructure. Therefore, the site is <br /> physically suitable for the type and intensity of development proposed. <br /> 4. The location, size, design, and operating characteristics of the proposed use will be compatible with <br /> and will not adversely affect the livability or appropriate development of abutting properties and the <br />
