surrounding neighborhood. <br /> • This finding can be made because the proposed solar energy facility will be located on an <br /> existing agricultural parcel and is designed to operate in a manner compatible with <br /> surrounding agricultural uses.The project includes a 14.47-acre fenced solar array within a <br /> larger 39.65-acre parcel, with the remainder of the site remaining available for continued <br /> agricultural use.The project will utilize an existing driveway for access from East Lone Tree <br /> Road and does not introduce residential, industrial, or commercial activities inconsistent <br /> with the surrounding agricultural setting. With implementation of required setbacks and <br /> operational standards for utility-scale solar facilities, the proposed use is not expected to <br /> adversely affect the livability or appropriate development of surrounding properties. <br /> Therefore, the proposed use will be compatible with the surrounding area. <br /> 5. The proposed use will not create any nuisances arising from the emission of odor, dust, gas, noise, <br /> vibration, smoke, heat or glare at a level exceeding ambient conditions. <br /> • This finding can be made because the proposed solar energy facility is a passive, non- <br /> emissive land use that does not involve the generation of odor, dust, gas, noise, vibration, <br /> smoke, heat, or glare at levels exceeding ambient conditions. The project consists of <br /> ground-mounted photovoltaic panels and associated electrical equipment that will operate <br /> in compliance with applicable County standards and manufacturer specifications, including <br /> Development Title Section 9-409.430(b)(8) that requires the facility to be designed to <br /> minimize reflective glare toward any habitable structure on adjacent properties as well as <br /> adjacent street. The facility will be unmanned during normal operations and will not <br /> generate operational nuisances typical of more intensive land uses. Temporary <br /> construction-related impacts will be short-term and subject to standard County mitigation <br /> measures under CEQA. Therefore, the proposed use is not expected to create nuisances <br /> exceeding ambient conditions. <br /> 6. The site of the proposed use is adequately served by highways, streets, water, storm drainage, and <br /> other public facilities and services. <br /> • This finding can be made because the project site is adequately served by existing public <br /> services and facilities. Access is provided via East Lone Tree Road, a County-maintained <br /> roadway,through an existing driveway. The site will continue to utilize existing private well <br /> water, septic, and stormwater systems,which are sufficient to serve the proposed use.The <br /> project does not propose new development that would require expansion of public <br /> infrastructure or services. Emergency access will be provided via the existing driveway and <br /> internal site circulation.Therefore,the site is adequately served by highways,streets,water <br /> supply,drainage, and other public facilities and services. <br /> 7. The proposed use complies with all applicable provisions of this Title. <br /> • This finding can be made because the proposed utility-scale solar energy facility is a <br /> conditionally permitted use within the AG-40 zoning district, subject to approval of a <br /> Conditional Use Permit and compliance with applicable Development Title provisions. <br /> Although the project exceeds the maximum size for solar facilities on agricultural properties <br /> (Development Title Section 9-409.430 (B) (5)), the Planning Commission can make the <br /> finding that the proposed facility will not adversely affect agricultural production. This <br /> finding can be made because the soil will be protected for future agricultural use upon <br /> decommissioning of the facility and the remainder of the site will remain available for <br /> current agricultural operations. The project has been designed to comply with applicable <br /> development standards, including required setbacks for ground-mounted solar energy <br /> systems in agricultural zones, as well as applicable screening, access, and operational <br /> requirements. The project site is currently subject to a Williamson Act Land Conservation <br /> Contract; however, renewable energy facilities are permitted subject to compliance with <br />
