Impacts to soil, and groundwater are currently unknown and <br /> require further investigation. <br /> 26.Based on the evidence discussed in the preceding Findings and as operator of the <br /> Site, SPI is suspected to have discharged hazardous wastes in a manner that <br /> could affect the quality of the waters of the State. As owners of the property <br /> wherein the Site is located, Wiley and Shawna Lynn Chandler had the ability to <br /> monitor and control the Site's uses and are therefore suspected to have <br /> discharged waste where it could affect the quality of the waters of the State. As <br /> owners of SPI, Rob Hrabe and Suhasini Pyarasani are suspected dischargers <br /> for operating the business in a manner that may have discharged hazardous <br /> waste at the Site that could percolate to groundwater (VRC Metals, 2022b).5 <br /> Mike Belmont is a suspected discharger because he has estimated that under <br /> his supervision, approximately five (5) gallons per day of operations of the rinse <br /> water and spent waste was discharged into the septic system since 2005 <br /> (SJCEHD, 2021 b). <br /> 27.The technical reports required under this Order are necessary to investigate actual <br /> and/or threatened discharges of waste to waters of the State and to ascertain the <br /> extent of pollution to soil and groundwater and impairment of designated beneficial <br /> uses. This information is needed to protect public health and the environment from <br /> contamination and to adequately protect groundwater and its beneficial uses. In <br /> particular, the Central Valley Water Board needs the required Site Audit and <br /> Chemical Storage and Use Questionnaire (Attachment A) to evaluate the extent of <br /> wastes discharged to soil and groundwater at and near the Site. The Central Valley <br /> Water Board further needs the required business documents to determine potential <br /> responsible parties in performing its due diligence required under State Water <br /> Resources Control Board (State Board) Resolution No. 92-49, subdivision I.B. <br /> 28.The burden of preparing the requested technical reports, including costs, bears a <br /> reasonable relationship to the need for and the benefits to be obtained through the <br /> provision of these reports. Central Valley Water Board staff prepared a Cost <br /> Estimate, dated 18 March 2022, for the technical report(s) required under this <br /> Order, which include sampling the septic tank, leach field soils, and groundwater, <br /> which demonstrates the total cost of the technical reports required under this Order <br /> may be between $90,000 to $120,000. As described in the preceding Finding, the <br /> required information is necessary to evaluate the potential magnitude of impacts <br /> from hazardous waste used at the Site and to investigate and delineate waste <br /> potentially discharged to soil and groundwater as a result of the activities <br /> performed at the Site. <br /> 29.Failure to timely submit the required reports may subject the Parties to <br /> administrative civil liability imposed by the Central Valley Water Board in an <br /> a In an email to the Water Board dated 9 March 2022, Michael McCormick of VRC Metals confirmed <br /> Suhasini Pyarasani is a co-owner with minority ownership in SPI. <br />
