Stockton Propeller, Inc. - 9 - 10 May 2022
Order R5-2022-0806
amount up to $5,000 a day for each violation pursuant to Water Code section
13268, subdivisions (b)(1) and (d)(1), or referral to the Attorney General for
enforcement.
30.This Order is issued under authority delegated pursuant to Water Code section
13223 and Central Valley Water Board Resolution R5-2018-0057.
REQUIRED ACTIONS
IT IS HEREBY ORDERED that, pursuant to Water Code section 13267, the Parties
shall comply with the following provisions.
1. By 10 June 2022, the Parties are required to complete and return to the Regional
Board a Site Audit and Chemical Storage and Use Questionnaire (Attachment
A).
2. By 25 May 2022, SPI is required to submit a Revised Septic Tank, Leach Field
Soil, and Groundwater Sampling Work Plan. This work plan is to inspect the
septic tank condition, collect and analyze additional samples from the septic tank
and soil around the septic tank, conduct a geophysical investigation to identify the
location(s) of the leach field and collect representative soil samples from the leach
field, and complete a groundwater investigation. As discussed in Finding 20, the
sampling plan SPI submitted on 22 February 2022 partially complies with this
required work plan by proposing sampling soils surrounding the septic tank (NES,
2022). The Revised Septic Tank, Leach Field Soil, and Groundwater Sampling
Work Plan shall include the remaining investigative work. The Central Valley Water
Board staff will review and comment on the Revised Septic Tank, Leach Field Soil,
and Groundwater Sampling Work Plan. The Central Valley Water Board Assistant
Executive Officer may reject the reports if any are deemed incomplete and/or
require revisions to comply with this Order.
3. Field work shall be completed by 1 October 2022. 60 days after the field work is
complete and the laboratory results are received, the Parties are required to submit
a Site Investigation Report. The Site Investigation Report shall include the
following elements, at a minimum:
a) Description of work performed, summary tables of the sample results,
certified laboratory reports, maps and figures depicting the soil and
groundwater analytical results and corresponding locations.
b) Conceptual Site model.
The Central Valley Water Board staff will review and comment on the Site
Investigation Report. The Central Valley Water Board Assistant Executive Officer
may reject the report if it is deemed incomplete and/or requires revision to comply
with this Order.
