OBSERVATION:The business plan information has not been reviewed and resubmitted in the California Environmental Reporting System (CERS)annually by the due date, January 15. The 2025 business plan was submitted late on 2/28/2025. REGULATION GUIDANCE:The hazardous materials inventory shall be submitted by January 15 of each calendar year and may be submitted beginning November 1 of the previous year. CORRECTIVE ACTION: Submit statement demonstrating the the HMBP will be annually submitted to CERS by the due date. This is a repeat violation (Class 2) Violation. 5 CA Health and Safety Code 25508.1(a)-(f) 1010006- Updated within 30 days of 100% increase or new haz; change of address/owner/name; or change in ops. OBSERVATION:The business has not updated and submitted the information in CERS within 30 days. Allen Cupples listed as the primary emergency coordinator under the contingency emergency response plan in CERS. Allen Cupples stopped working for the facility in April 2025. GUIDANCE: Within 30 days of one the following events, business shall electronically update the information submitted to the California Environmental Reporting System (CERS): a) A 100 percent or more increase in the quantity of a previously disclosed material. b) Any handling of a previously undisclosed hazardous materials c) A change of business or facility address d)Change business ownership e)Change of business name f)(1) A substantial change in the handler's operations occurs that requires modification to any portion of the business plan. (2) For the purpose of this subdivision, "substantial change"means any change in a facility that would inhibit immediate response during an emergency by either site personnel or emergency response personnel, or that could inhibit the handler's ability to comply with Section 25507 , change the operational knowledge of the facility, or impede implementation of the business plan. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS)at http://cers.calepa.ca.gov/, enter the correct or updated information, and submit to the EHD for approval.
