The monitoring site plan was: - not scaled REGULATION GUIDANCE: § 2650(c) Monitoring Site Plan —Owners or operators must submit a monitoring site plan for approval by the Unified Program Agency. The monitoring site plan must include, but is not limited to, the following: (1)A scaled diagram indicating the layout of the tank(s) and piping to the extent known, including containment sumps; (2) Locations of all release detection equipment; and (3) If applicable, each vacuum, pressure, or hydrostatic interstitial monitoring zone. CORRECTIVE ACTION: Submit and maintain a monitoring site plan. This is a (Minor)Violation. 5 23 CCR 16 2613(a)(6) and (b), 2650(a), (d), and (e) 2011013 - Facility has submitted a complete and accurate UST Response Plan OBSERVATION: Owner/Operator failed to submit a complete and accurate UST Response Plan. The UST Response Plan submitted in CERS does not have emergency contact information listed for Responsible Persons or a 24 hour phone number for a continuously staffed emergency operations center. REGULATION GUIDANCE: § 2650(d) Response Plan —Owners or operators must submit a response plan to the Unified Program Agency which demonstrates, to the satisfaction of the Unified Program Agency, that any unauthorized release will be removed from the secondary containment as soon as practical. This must be within a time consistent with the ability of the secondary containment to contain the hazardous substance but must not exceed 30 days. The response plan must include, but is not limited to, the following: (2) For methods of monitoring where the presence of the hazardous substance in the interstitial space cannot be determined directly, for example, where liquid level measurements are used as the basis for determination, the response plan must specify the proposed method(s)for determining the presence or absence of the hazardous substance if the indirect method indicates a possible unauthorized release of hazardous substance. CORRECTIVE ACTION: Submit a complete and accurate UST Response Plan. This is a Repeat(Class 2)Violation. 6 23 CCR 16 2613(a)(7) and (b), 2690(a)(5); HSC 6.7 25292.2 2011008-Submitted/maintained current Cert of Financial Responsibility/mech of financial assurance (TCR 11) OBSERVATION: Owner/Operator failed to submit and/or maintain a complete and current Certification of Financial Responsibility or other mechanism of financial assurance. The financial responsiblity documents in CERS and on site are outdated. The Certification of Financial Responsiblity and Letter from Chief Financial Officer Letter are dated 7/31/2024. REGULATION GUIDANCE: § 2613 (a)(7) Certification of Financial Responsibility in accordance with section 2809.1§ 2809.1 (a) Owners and operators must maintain evidence of all mechanisms used to demonstrate financial responsibility in accordance with the provisions of this article until the provisions of this article no longer require such maintenance. Such evidence must be maintained at the underground storage tank site or sites or the owner or operator's place of business. CORRECTIVE ACTION: Submit a complete and current Certification of Financial Responsibility, or other mechanism of financial assurance within 30 days. This is a Repeat(Class 2)Violation.
