1 . 3 Prior Notice of Commencement of Work <br /> At least 72 hours prior to the commencement of activities <br /> on Owner' s Property pursuant to this agreement, STTC shall <br /> provide facsimile and telephone notice to Owner and to <br /> affected tenants of Owner, detailing the work to be <br /> conducted on Owner' s Property, the equipment to be used, <br /> and the sort of access to the property that is required. <br /> Owner ' s current tenants on the affected property are listed <br /> on Exhibit "B" attached hereto. <br /> 2 . Conduct of Operations <br /> 2 . 1 No Undue Interference <br /> STTC shall perform all activities on Owner' s Property in <br /> such a manner as not to interfere unduly with or disrupt <br /> the normal operation of activities and or any future and <br /> upcoming development on the property, and so as not to <br /> endanger the health, safety, or welfare of employees, <br /> agents, clients, tenants, or others present on <br /> Owner ' s Property. <br /> 2 . 2 Changed Uses of Owner ' s Property <br /> In the event that Owner' s or its tenant ' s use of Owner ' s <br /> Property changes in a manner inconsistent with the location <br /> of one or more of the installed monitoring wells, then the <br /> STTC shall close and abandon such wells in accordance with <br /> all applicable federal, state or local governmental <br /> requirements . Thereafter the parties shall work together <br /> in good faith to determine acceptable locations for <br /> replacement wells that will meet the Water Board' s <br /> requirements, that will not interfere unduly with <br /> anticipated operations on Owner' s Property, and that will <br /> minimize relocation costs for the STTC as much as possible . <br /> Any such well removal and replacement of monitoring wells <br /> shall be done at the STTC sole cost and expense . <br /> 2 . 3 Removal and Restoration <br /> STTC shall remove any necessary material and equipment from <br /> Owner ' s Property promptly upon completion of the necessary <br /> work, and shall restore Owner ' s Property to its condition <br /> prior to the conduct of such work. <br />
